ON TUESDAY, DECEMBER 4, 2018, IN THE COUNCIL CHAMBERS OF THE VINTON
MUNICIPAL BUILDING LOCATED AT 311 SOUTH POLLARD STREET, VINTON,
VIRGINIA

The Mayor called the regular meeting to order at
7:00 p.m. The Town Clerk called the roll with
Council Member McCarty, Council Member Scheid,
Council Member Stovall, Vice Mayor Liles and
Mayor Grose present. Roll call
After a Moment of Silence, Chasity Barbour, led
the Pledge of Allegiance to the U.S. Flag.
Under upcoming community events, Council
Member McCarty announced the following: State
of the Town — 8-9:30 am - Vinton War Memorial;
December 6 — Vinton Christmas Parade with the
Vinton Breakfast Lions Club spaghetti dinner
starting at 4:00 pm - VFW building; December 7-16
— Star City Playhouse Double Feature; December
11 — Colonial Downs Ground Breaking and Ribbon
Cutting — 10:30 am and December 13 — Chamber
Open House—5-7 pm—Chamber Office.
Council Member McCarty made a motion to
approve the Consent Agenda as presented; the
motion was seconded by Vice Mayor Liles and
carried by the following vote, with all members
voting: Vote 5-0, Yeas (5) — McCarty, Scheid, Approved minutes of the Regular
Stovall, Liles, Grose, Nays (0)—None. Council meeting of November 20, 2018
Under awards, introductions, presentations,
proclamations, Chasity Barbour made brief
comments and introduced Dana Boyd, Community
Program and Facilities Supervisor and Amanda
Payne, Community Programs & Facilities
Coordinator.
The net item on the agenda briefing on
proposed Ordinance to repeal Article 1, In {general,
and Article 11, Recycling, of Chapter 7 ; Solid
Waste, in its entirety by adopting and enacting
Article `l, In general, Article 11, Recycling and Article
III, Penalties of Chapter 7 , Solid haste, of the
Town Code. The Town Manager began by
commenting that the Public Works Committee met
and reviewed several drafts of the proposed
ordinance and the Town Attorney also provided a
legal review. The draft"which was a pact of the
agenda package contains all of the recommended
changes. Also included with the agenda package
was a letter; application/ agreement and physicians
certificate for medically excused service.
The Town Manager next began commenting on the
bullet list that was a parr of the agenda package;
first on the definitions of downtown business area,
medically excused service and town-issued refuse
cart.
With regard to the medically excused service; Public
Works has been reviewing and updating their
current list for this service. The new forms will b
mailed out by the end of this week with a deadline
of mid to late ,January 2019. As new individuals
apply for this service, they will be provided these
same farms and everyone will be required to re-
apply each year. Council Member Scheid asked
how we would inform individuals that this service is
available and the Town Manager responded it
would he a part of our mailings as well as on our
website and all social media.
The Town Manager next commented on the bullet
points under Section 7 - , refuse carts to be
provided by the town. Council Member Scheid
asked if the second cart could be either a 9 -gallon
or 64-gallon cart. °The Town Manager responded
that it could be and the rental rate would be the
same. If the number of units at a service location
is five or more or they request more than three
refuse carts, they shall be required to have private
refuse collection service. Some of the businesses;
churches and apartment complexes that could
possibly be impacted by this change were identified
on the bullet list. Vice Mayor tiles commented
those locations have citizens who pay taxes and
currently get free refuse collection and expressed

concern about who would be responsible for the
cost of using a private hauler. Council Member
Scheid commented that the Committee discussed
having some type of meeting either one or one or as
a groin with some of these apartment complexes or
their managers. that we are proposing is not any
different from what other localities do as far as
apartment complexes are concerned. Further
comments were made regarding the difference
between rental apartments and individually owned
units such as town houses, Council Member Stovall
asked if we are currently picking up the trash at the
locations listed and the gown Manager responded
yes. However, there are some apartment
complexes that already have dumpster service or
private haulers. With regard to the Dillon Woods
Town Houses, the Town Manager commented that
if we choose to pick up their refuse, we can get hold
harmless agreements signed by the residents.
Council Member Stovall next asked if we were
picking up at all of the businesses and churches.
The Town Manager responded that some of them
have dumpsters and it depends on the number of
cans they require. if it is over three mans, then we
do not pick it up. Council Member Stovall further
commented that it would be a problem when we
introduce this new program and we step collecting
from those we are currently servicing. William "Bo"
Herndon commented from the audience that he
clues not feel there would be a problem with the
churches and businesses we currently pick up from
now because most of them only have one can, The
9 -gallon cans will hold more especially if they bag
and disperse of it properly. The Town Attorney
commented that the current ordinance provides that
you can have 12 cams of 30 gallons each of refuse
per week which totals 360 gallons. In the business
district where there are three collections a week,
then the permitted amount under the new ordinance
would be over 990 gallons.
After additional comments and discussion regarding
the current refuse collection process at the South
Hampton development, the Town Manager
commented that we need to meet with the HA.
Pete Peters asked if there would be an opportunity
for a community corral with several dozen cans that
anyone could use that lived there. Mr. Herndon
commented on where the corral might be located so
the truck does not have to go on private property..
The Town Manager next commented on Section -
, use of the town-issued refuse carts, that only
refuse contained in town-issued carts would be
collected. If a resident filled the cart up and put
their bags outside of the cart, it would not be picked
u . The Town Attorney pointed out in Section 78-

that any extra trash can be taken to the Tinker
Creek Transfer Station. It is her understanding from
Public Works that the taxpayers of Vinton can take`
12 loads of trash to the station each year at no
charge.
The Town Manager next commented that we plan to
mail an information sheet to all of our service
locations to let them know of the upcoming
changes. This will need to go out before we have
the Public Nearing so citizens can be given the
opportunity to ask any questions or come before
Council with their concerns. Mr. Herndon is
working with Mr. Peters to coordinate some
meetings with about 10-1 of the downtown
merchants and we are going to be sending out:
information to the apartments and meeting with
them as well. We wanted to brief Council on the
first draft of the ordinance to Council before we
scheduled those meetings. With regard to the
Public Nearing, the Town Clerk commented that it
could be held the second meeting in January, since
we will not have our first meeting.
With regard to Section 78-1 g, other collection►
services, this section incorporates these services
that are currently in a separate policy which will
assist with better enforcement.
Under Section 8-21, screening of private
umpster , the Town Manager commented that the
only reference to screening in our zoning ordinance
is for restaurants. There needs to be a screening
requirement and this proposed ordinance needs to
be consistent with the zoning ordinance. There
were no changes to Article 11, Recycling and Article
III, Penalties, was added to include penalties for
both solid waste and recycling.
The Mayor commented that he is not in agreement
with our current screening requirement of the
dumpster being completely screened. The problem
with that is the front doors stay open all the time.
He felt that the practical solution that seems to work
in other locations in town is to have a side entrance
for those who are taking out the trash on a daily
basis so they do not have to open the front doors.
This would make the front doors the responsibility of

those operating the truck that empties the
dumpsters, Council Member Scheid commented
that it needs to be consistent between the zoning
and solid waste ordinance:
The Town Manager commented in closing that the
next steps would be to mare contact with the
apartments that are over fire units and the
downtown merchants that have been identified. We
will be sending out information to our service
locations to let there knew what changes are being
matte in our refuse collection. The Town Manager'
expressed thanks to Council Member McCarty,
Council Member Scheid, Joey Hiner, Bo Herndon,
Jill Acker, the Town Clerk and Town Attorney for all
the work on creating this first draft of the ordinance:
We feel that once our ordinance is adopted, that it
will become a model ordinance for other localities.
The Town Clerk asked if this ordinance needs to be
revisited at the meeting on December 13 ". Council
Member Scheid responded that we have another
Public forks Committee meeting in January prior to
our Public blearing and it would depend on the input
received from the apartments and businesses that
will be contacted. The Town Manager commented
e could move the Public Hearing to the first
meeting in February to give us enough time to move
through all the things we need to do and that would
still give us plenty of time to get our educational
materials out and stay on target to meet our April 1
deadline. Council agreed that we can keep then
updated on the matter and be flexible with the
scheduling of the Public bearing.
The Town Manager announced that the Town
has been awarded the two PSAP grants that will
fund the two pedestrian safety improvement
projects at the intersections of Washington Avenue
and Pollard Street, and lardy Roan and Vinyard
Road. The projects were fully funded by VDC T with
no local match requirements and will be
administered by the Salem District Office. The total
funding received for the Washington/Pollard
intersection project was $121,3 0, and $99,200 for
the Vinyard/Hardy intersection project, for a total of
$220,5 0. There were only 25 projects across the
state that were selected and the town was
competing with large municipalities such as
Richmond, Virginia Beach, Norfolk ;and Fairfax
County. The projects are projected to be
implemented and constructed by December 2019 or
early 2020.

Chief Foster read a quote from George
Bush, "America is never wholly herself unless she is
engaged in high moral principle. We as a people
have such a purpose today. It is to make kinder the
face of the nation and gentler the face of the world."
e Mayor commented on the recent Roanoke
Malley-Alleghany Regional Commission annual
meeting last week and congratulated Council
Member Scheid and her husband for their
completion of the three-day Susan G. F ome i Walk
recently. Council Member Scheid commented
there were 2,400 walkers and they raised $6.3
million.
The Town Clerk reminded Council that prior to
the December 18th meeting, there will be dinner at
5:30 p.m. and a joint work session with the Planning
Commission at 6:00 pm.
Comments from Council. Council Members
Stovall and McCarty commented on the success of
the opening of Macado's Vice Mayor tiles also
commented on the Macado's opening, the upcoming
town calendar and the success of the participants on
the UDA Committee.
The Mayor announced that Dan O'Donnell was
appointed the new Roanoke County Administrator.
Vice Mayor Liles made a motion to adjourn the
meeting; the motion was seconded by Council
Member McCarty and carried by the following votes
with all members voting. Vote 6-0; Yeas (6)
McCarty, Scheid, Stovall, Liles, Grose; Days 6j
