Roll call After a Moment of Silence, Council Member Liles led the Pledge of Allegiance to the U.S. Flag. Regular Meeting of November 1, 2022; adopted Resolution No. 2523 appropriating funds in the amount of $1,357.95 for the receipt of an insurance claim made on a Department Under awards, introductions, presentations and proclamations, the next item on the agenda was the Development Specialist. Following comments by the Town Manager, t Mr. Stanley to the Town. The next item on the agenda was the consideration of proposed Amendment to the Town of Vinton Reference the Town of Vinton GAP Summary – Route 24 Bike/Ped Plan, May 2022. opened the Public Hearing at 6:12 p.m. Nathan McClung commented that Council has been briefed on this matter several times, most recently at November 3, 2022 the Vinton Planning Commission voted unanimously to adopt the Plan. The purpose of adopting the recommended improvements are made eligible for solidifies and legitimizes the w Committees, Town Staff and Vinton residents. Hearing no public comments, the Mayor closed the Public Hearing at 6:14 p.m. Council Member Liles made a motion to adopt the Ordinance as seconded by Vice Mayor McCarty and carried by the following roll call vote, with all members voting: Vote 5-0; Yeas (5) – Liles, Mullins, Grose; Nays (0) - None. Public Hearing Opened Public Hearing Closed Adopted Ordinance No. 1047 approving an Vinton GAP Summary – Bike/Ped Plan, May 2022 The next item on the agenda was a briefing on an Intergovernmental Agreement between th Roanoke and the Town of Vinton relating to the City of Project. Anita McMillan first commented that Town Staff and Roanoke County Staff have been working with Roanoke City on their streambank restoration project since 2021. Just like the Woodland Place, 3 of Environmental Quality (DEQ) Stormwater Local Assistance Funds (SLAF) and will benefit the Town just Roanoke County’s Project, Phase I and II. Roanoke City has to meet the DEQ Total Maximum Daily Load (TMDL) allocation requirements and even though the property belongs to the Town, the City will get the benefit of the TMDL allocations. The map showing the four properties in the Town limits and two that are located within Roanoke City were included with the agenda package. Attorney has reviewed the Agreement. The Town Manager commented that Staff would encourage the City to share details of the project with their citizens because although the primarily in the City, it will have some traffic impact on our residents. The Town Manager commented that the Garthright yesterday. He also announced that o vendor has indicated that the equipment has arrived for the traffic signals on Niagara./Vinyard and By- Pass/Hardy provided. The next item on the agenda was on the current commented there are Development and Public Safety. Each election year Council Members are appointed to serve years on these Committees. Staff would like to dissolve Committee and any items that would typically go to that Committee would be referred to Public Works or the Highway Safety Committee. Staff would also like to create a new Community Development Economic Development. provides an opportunity to evaluate items and flush out the details before being presented at a Council Meeting. 4 months so we would have a more frequent meeting schedule. The Town Clerk commented that asked to take action at their D meeting to dissolve the Economic Development and Public Safety Committees and create the new Community Development Committee. The Town Clerk next congratulated Council Member Stovall and Vice Mayor McCarty on their re-election to Council. Since this is the Town’s first November election, the organizational January 3, 2023 at which time Council Members will be appointed to the three Committees. Under reports from Council Committees, Andrew Kee Committee met on November 7, 2022 Committee reviewed the Resolution for damage to Consent Agenda. Report, Mr. Keen commented that all of the major revenue sources such as personal property, pari- cigarette stamps are personnel, remains under budget and all other under budget. At this point there have not been any trends affecting the revenue or expense side to date. approximately $14 million with approximately $6 million being restricted cash. There was an increase of approximately cash. commented that currently there is approximately $3.3 million in investments in a combination of money markets, CDs and trust funds. To date there has been minimal growth in essentially $500 in accrued interest. Mr. Keen next commented that a Town’s investment policy, there are objectives-- maintenance of liquidity and maximizing Given the current interest rates, he contacted all of 5 and what might be best suited for the Town’s funds. There were a variety of focus on the maximizing the return, but forever even though the investment policy allows us to do a CD for up to 24 months. One of our local banks offered a CD at 3.8% for four months, so we moved money from our Utility Fund checking account, which was earning no interest to a CD, which will earn approximately four-month period. These funds can be turned over three times annually and make $75,000 in earnings as long as interest rates remain where they are. Mr. Keen next commented that currently we have a money market of $1.6 million that has been earning 040% interest. In working with the same bank, we were able to get an interest rate of 2.75%, which will increase the earnings over a one-year period from $6,000 to approximately $44,000. Cody Sexton commented that in June when we were Now five months later Mr. Keen is finding 3+% which is more than double in a five-month period. Report Council Members commented on the recent Veterans Luncheon, the announcement of Pok-E wished everyone a Happy Thanksgiving. The Mayor reminded everyone again of the Vice Mayor McCarty and Council Member Stovall for being re-elected to Council, the recent Roanoke Valley-Alleghany Regional Commission and wished everyone a Happy Thanksgiving. Attachments None Recommendations No Action Required Town Council Agenda Summary Meeting Date December 6, 2022 Department Finance/Treasurer Issue Consideration of public comments concerning the proposed amendment to the Town of Vinton’s FY 2022-2023 budget to appropriate funding for the Capital Fund and the projects budgeted therein from the Utility Fund balance in the total amount of $2,984,236.25. Summary In July 2022, the Town of Vinton transferred its water and wastewater utility system to the Western Virginia Water Authority (WVWA). The agreement between the Town and the WVWA allowed the Town to keep the remaining fund balances for the Utility Fund. Town staff had estimated those balances to be $2,500,000.00 and budgeted that amount for capital projects in the fiscal year 2022-2023 budget. The actual amount of remaining fund balances exceeded that estimate. The requested budget amendments reflect the transfer of the originally budgeted $2,500,000.00 from the Utility Fund plus the additional transfer of $484,336.25 from the Utility Fund to the Capital Fund’s Highway Maintenance Capital Outlay account for general road projects. Section 15.2-2507 of the 1950 Code of Virginia, as amended, requires any locality to hold a Public Hearing in order to amend its budget when any such amendment exceeds one percent (1%) of the total expenditures show in the currently adopted budget. The Notice of this Public Hearing was advertised in The Vinton Messenger on November 23, 2022. Summary The amended definition of “property” found in the proposed ordinance would allow for the Town to align the respective code section concerning the abatement of overgrown weeds with the current policies/practices being administered by both the Planning and Zoning Department and Public Works Department for areas located in the public right-of-way. By amending this definition of “property,” the current practice of requiring the abatement of overgrowth within reasonable areas of the public right-of-way between the private property line and curb, improved portion of roadway, or the centerline of any alley or unimproved street will be clarified to all stakeholders involved and legitimized through its formal codification. Johnson, CMC, Town Clerk Meeting Date December 6, 2022 Department Planning and Zoning Issue Consider adoption of an Ordinance to amend Chapter 10, Animals, Article III, Animals Other Than Dogs and Cats, Sec. 10-97, Fowl, Chickens and Other Domestic Birds, of the Vinton Town Code. Summary The amendment of section 10-97 is as a direct result of expressed interest by town residents. The proposed ordinance would amend a requirement that disqualified many residents from procuring and raising Chickens; specifically the requirement of needing to have a minimum one (1) acre of land. The frequent rates of permit denial due to this requirement and the increased interest in raising backyard chickens prompted the Planning and Zoning Department to conduct preliminary research. The research findings showed that the town has a much more restrictive code in regards to raising chickens when compared to other localities, both in the region and across the state. Most localities allowed 6 or more chickens based on smaller lot size requirements when compared to the town. This research has allowed us to make the proposed changes to the current regulations to not only amend the lot size requirement, but to also address other standards such as setback requirements, permitting, and enforcement standards. Locality Applicable Code Sections and Definitions See Sec. 10-97 of the Vinton Town Code Roanoke County (pop. 95,583) Sec. 5-38. - Standards for residential chicken keeping. Standards: • Single-family dwelling – Owner Occupied. • Predator-resistant coop or chicken enclosure at all times. • TEN ft setback for rear and side lines – THIRTY-FIVE (35) feet from residential dwelling on an adjacent lot. - Behind the front building line of the principal structure. • Coops shall provide at least TWO (2) square feet of interior space per chicken and chicken enclosures shall provide at least TEN (10) square feet of exterior space per chicken with a maximum total area of two hundred fifty (250) square feet for both the coop and chicken enclosure. Neither the coop nor chicken enclosure shall exceed ten (10) feet in height. • Coops and chicken enclosures shall be securely constructed, well-ventilated and kept in a clean, dry and sanitary condition at all times. • Provision shall be made for the storage and removal of chicken waste (manure). Such waste shall not create a nuisance or health hazard to adjoining property owners. • All chicken feed or other material intended for consumption by chickens shall be kept in containers impenetrable by rodents, insects or predators. • The keeping of roosters, capons, and crowing hens is prohibited. 3 | P a g e • City of Roanoke (pop. 99,920) Sec. 6-96. - Fencing; roaming at large. All poultry shall be kept in securely and suitably fenced areas, and no fenced area or pen for poultry shall be permitted closer than fifty (50) feet to any house or other building used for residential purposes by anyone other than the person maintaining such poultry or his immediate family. No poultry shall be permitted to roam at large. Sec. 6-97. - Maintenance of area where kept. Every person maintaining any area for keeping poultry shall keep it clean, sanitary and free from refuse. All poultry feed or other material intended for consumption by poultry shall be kept in containers impenetrable by rats or other rodents, and such containers shall be equipped with tightly fitting caps or lids. The presence of rats in an area used for the keeping of poultry shall be prima facie evidence that such area is maintained in violation of this section. Town of Blacksburg (pop. 44,215) Section 5-118. - Urban chickens. Keeping "urban chickens," is subject to the following terms and conditions: • No more than six (6) hens shall be allowed for each single-family dwelling. • No roosters shall be permitted at any time. • Chickens shall be kept in an enclosed area (max 128 square feet), hereinafter known as a "pen." Pens shall include a coop, an enclosed structure containing a minimum of four-square foot per hen and an open run area containing a minimum of eight square feet per hen. • Pens must be located in the rear yard and shall be situated at least fifteen (15) feet from all property lines and fifty (50) feet from dwellings on adjacent properties. In addition, all pens shall be located at least twenty (20) feet from streams, tributaries, ditches, swales, stormwater management facilities, drop-inlets, or other storm drainage areas that would allow fecal matter to enter any storm drainage system or stream. • All pens must be kept in a neat and sanitary condition at all times, and must be cleaned on a regular basis so as to prevent offensive odors. • All feed for the hens must be kept in a secure container in a garage, shed or the residence to prevent the attraction of rodents and other animals. • Adequate shelter, care and control of the hens is required. Any person permitted to keep urban chickens 4 | P a g e pertaining to, but not limited to, the adequate care and control of animals. • Application submission requirements and registration. a. Persons wishing to keep hens pursuant to this subsection must file an application with the town's department of planning and building development, which application shall include: i. A sketch showing the area where the chickens will be housed and the types and size of pens in which the chickens shall be housed. The sketch must show all dimensions and setbacks. ii. A thirty-dollar ($30.00) application fee. iii. Applicants are encouraged but not required to give notice to adjacent property owners. For purposes of this section, "adjacent property" means all parcels of privately owned land that the applicant's property comes into contact with at one or more points, except for parcels that are legally adjacent to but are separated from the applicant's property by a public or private street. iv. Documentation that the property owner consents to keeping chickens on the property. b. Once the application has been reviewed and approved, the department of planning and building development shall issue a registration, which shall be valid for one (1) year. c. Each existing registration will be renewed on an annual basis by procedures developed by the town's department of planning and building. (c) Town of Christiansburg (pop. 21,943) Sec. 42-663. - Urban agriculture; zoning permit required. Pens … shall have setbacks of 15 feet from all property lines and 50 feet from dwellings on adjacent properties and no closer to the street right-of-way than the primary dwelling. Such permits shall be valid for chicken hens, chicks and bees only. NO roosters, ducks, geese, quail, turkeys, ostriches, peacocks, or any other non-domesticated pet. All approved urban agriculture uses are required to contain the hens and/or chicks and not allow them to roam at large. Chickens shall be kept in a fully enclosed, secure area not to exceed a total of 128 square feet, hereinafter known as a pen. Pens shall include a coop (enclosed structure) containing a minimum of two square foot per hen and 5 | P a g e all times. All approved urban agriculture uses shall maintain the premises in a clean and sanitary manner and are required to present measures for food storage and containment and disposal of waste prior to approval and shall maintain compliance with all presented measures. The operation of an urban agriculture use shall not include the slaughtering or butchering of chicken hens or chicks. All approved urban agriculture uses are subject to inspection by the zoning administrator or designee for compliance. All applicants for urban agriculture are responsible for obtaining permission of the property owner and approval of urban agriculture zoning permits does not constitute waiver of any restrictive covenants. Applicants for an urban agriculture zoning permit shall submit the following for review and approval of the zoning administrator: 1) Site drawing showing the size and location of all proposed structures and use areas, the setback distances from street rights-of-way, property lines and nearby dwellings, and any provisions for screening; (2) Management plan addressing protection from predators, use of feeding and bedding materials, management and disposal of wastes, and other factors deemed relevant for the protection of the public health. The town manager or zoning administrator shall have authority to approve urban agriculture zoning permits and may revoke such permits for noncompliance. A permit shall be valid for one year and require a $25.00 fee. The permit is renewable on an annual basis, with the appropriate fee. Should the town manager or zoning administrator have questions regarding compliance with an urban agriculture zoning permit, the town manager or zoning administrator may seek an advisory opinion or recommendation from the planning commission regarding compliance with the permit. The keeping of a garden for the production of fruit or vegetables shall not require an urban agriculture zoning permit and shall be allowed by right in all zoning districts. Pens may be portable. • The materials used for pens shall be uniform and kept in good condition in order to protect the safety of the chickens • All pens shall be deemed accessory structures and shall comply with the setback requirements as provided in section 106-202.3 (B)(2) herein, and shall be no closer than 50 feet from any adjacent principal structure, situate on an adjacent parcel, other than that of the owner of the chickens. Portable pens shall be moved on a regular basis. • All pens shall be located in the rear yard only. • All pens shall be located out of any drainage areas that could allow fecal matter to enter a storm drainage system or stream. • All pens shall be constructed and maintained so as to be impermeable to rodents, wild birds, and predators, including dogs and cats, and to prevent such animals or other pests from being harbored underneath, inside, or within the walls of the enclosure. All pens must be kept dry, well-ventilated, and in sanitary condition at all times, and must be cleaned on a regular basis to prevent offensive odors. All manure not used for composting or fertilizing shall be removed promptly. Odors from chickens, manure, or other chickens-related substances shall not be detectable at the property boundaries. • All feed or other material intended for consumption by the chicken shall be kept in containers impenetrable by rats or other rodents, and such container shall be equipped with tightly fitting caps or lids. All feeding shall be conducted in a manner so as to prevent unconsumed food from being accessible to other animals or rodents. The presence of rodents in an area used for the keeping of chickens shall be prima facie evidence that such area is maintained in violation of this section. • Composting of chicken litter and waste on site is highly encouraged. If any litter and/or waste is to be disposed of, it must be double bagged and securely closed and deposited in either a city approved receptacle or taken to the city transfer station. Also, any dead chickens shall also be double bagged and securely closed and deposited in either a city approved receptacle or taken to the city transfer station. • Disposal of litter, waste, and dead chickens on public land or in the sewage or stormwater collection system is strictly prohibited. • 7 | P a g e Administration. Persons wishing to keep chickens pursuant to this subsection must file an application with the city zoning department. The application shall include a sketch showing the area where the chickens will be housed and all types and size of enclosures in which the chickens will dwell along with a $25.00 fee. The sketch must show all property dimensions and setbacks. Once the site and enclosures have been inspected and approved by the city's animal control officer, a permit will be issued. The permit shall be valid for one year. Each existing permit must be renewed annually in July by filing an application with the city zoning department, along with payment of a $25.00 renewal. The animal control officer shall make another inspection of the site, prior to the approval of the renewal application. 2. Any violations found may subject the owner to revocation of their permit and to criminal charges as provided herein. 3. The provisions of this section shall be enforced by the zoning administrator and such enforcement authority may be delegated by the administrator to the animal control office or other departments of the city. 4. Any person violating any of the provisions of this section shall be deemed guilty of a class 4 misdemeanor. Each day a violation continues shall constitute a separate offense. 5. The keeping of chickens in AG—Agriculture district shall conform with the requirements of section 106-302 herein, and shall not be subject to the provisions of section 106- 316.3 and section 106-318. (D) Existing use at time of enactment. Notwithstanding the foregoing provisions of this section, places of residences where chickens (roosters not being permitted under any circumstances) are currently being kept at the time of enactment of this ordinance shall have a period of two years from such date of enactment to comply with the requirements herein. However, those eligible hereunder shall, on or before August 1, 2012, declare and certify such existing use to the satisfaction of the city and make application as required by section 106-318.1(C). Town of Vienna, VA (pop. 16,522) Sec. 18-12. - Permitted uses. Agricultural operations, including floriculture, horticultural and nurseries, provided all structures and buildings used in connection therewith are at least 100 feet from the nearest property line; poultry and dairy farming and horse breeding on parcels of at least ten acres in area, provided all animals and buildings and structures used in connection therewith are located at least 100 feet from the nearest property line. Town of Bedford, VA (pop. 6,561) Sec. 602. - Single Family Residential District R-1. 8 | P a g e following conditions: i. Each parcel shall contain one single family dwelling and must have a minimum size of 10,000 square feet. The dwelling may not be used for residential purposes by anyone other than the person maintaining such chickens as are permitted or his or her immediate family. ii. Chickens are defined herein as domestic female chicken hens. Roosters are prohibited. iii. Chickens shall be kept for the household's personal consumption only. Commercial use (such as selling eggs or selling chickens for meat) shall be prohibited. No slaughtering or processing of chickens shall take place. iv. No more than six chickens shall be allowed. v. Chickens shall not be allowed to roam free. They shall be kept in securely and suitably fenced areas. All pens must be no closer than 50 feet from any principal structure. All pens shall be located within the rear yard only. vi. Every person maintaining any area for keeping chickens shall keep the area clean, sanitary and free from refuse. All feed or other material intended for consumption by chickens shall be kept in containers impenetrable by rats or other rodents, and such containers shall be equipped with tightly fitting caps or lids. The presence of rats in an area used for the keeping of chickens shall be prima facie evidence that such area is maintained in violation of this section. Town of Culpepper, VA (pop. 17,557) Sec. 3-10. - Cleanliness of stables, kennels, etc. All cow stables, chicken houses, dog houses or kennels or other facilities for keeping livestock, fowl, poultry or dogs, kept of maintained within the town, shall, in addition to any town, county or state requirement now existing or hereafter enacted, be under the supervision and regulations of the county health department. Such stables, etc., shall be kept in a clean and sanitary condition for the protection of health, and shall be kept so as not to give rise to objectionable odors upon any public highway or upon any premises owned or occupied by any person other than the person maintaining such stables or other facilities. (b) Any person, having been given notice in writing by the county health department to correct any conditions called to his attention by the county health department, shall correct such condition within ten (10) days from the receipt of 9 | P a g e Town of Warrenton, VA (pop. 9,897) Sec. 3-4. - Fowl, poultry and livestock running at large. It shall be unlawful for any person to allow or permit any fowl, poultry or livestock of any description, to stray to public property or private premises of another, and all fowl, poultry or livestock shall be sufficiently housed or fenced up by the owner or person exercising control over such fowl, poultry or livestock, so as to prevent such fowl, poultry or livestock from trespassing or straying. (b) It shall be unlawful for any person to permit any animal belonging to him or under his control, and known by him individually or by repute to be dangerous, mischievous or vicious, to go at large. Any animal at large in violation of this provision may be killed by any police officer upon the written order of the judge of the general district court. Any person owning or having custody or control of fowl within the town shall provide for such fowl a suitable pen or other enclosure or place of habitation and physical restrictions which prevent the fowl from leaving the premises. It shall be his duty to maintain such place at all times in a safe and sanitary condition, free of excrement and other unsanitary or offensive substances or liquids, and so as not to constitute a hazard to the health or safety of any person Purcellville, VA (pop. 9,232) Sec. 10-3. - Confinement of fowl. (a) Definitions. Fowl is defined as any various domestic birds by way of example but not limited to: Chickens, roosters, ducks, geese, turkeys, guinea fowl, emus, rheas, ostriches and pigeons. (b) It shall be unlawful for any person to keep, permit or allow any domesticated fowl within the corporate limits of the town, or to allow any domesticated fowl to run at large within the corporate limits of the town, except as specifically permitted below. (c) It shall only be lawful for a person to keep, permit or allow chickens within the corporate limits of the town on residential property only, under the following terms and conditions: (1) The principal use of the property shall be a single-family dwelling. No chickens shall be allowed on townhouse, duplex, apartment, or manufactured housing park properties. (21) No more than six chicken hens shall be allowed for each single-family dwelling, with roosters prohibited. No chickens shall be allowed on townhouse, duplex, apartment or manufactured housing park properties. (32) No roosters shall be permitted at any time. (42) Chicken hens allowed under this section shall only be raised for domestic purposes and no commercial use such as selling eggs or selling chickens for meat shall be allowed. There shall be no outside slaughtering of chickens. (3) Each single-family dwelling shall contain at a minimum an acre (43,560 square feet) of land. 2 (45) Chicken hens shall be kept in an enclosed secure movable/portable pen/chicken tractor, stationary pen or a fenced enclosure (henhouse/coop) that contains at a minimum four square feet per bird. The size of the enclosed portable and/or stationary henhouse/coop shall not exceed 64 square feet in area. Chickens Birds shall not be allowed to roam free. They shall be kept in an enclosed secure area not to exceed a total of 128 square feet, hereinafter known as a pen. (56) The materials used in making a pen henhouse/coop or chicken tractor shall be uniform for each element of the structure such that the walls are made of the same material, the roof has the same shingles or other covering, and any windows or openings are constructed using the same materials. The use of scrap, waste board, sheet metal, or similar materials is prohibited. Henhouses and chicken tractors Pens shall be well maintained. (67) All pens enclosed permanent henhouses/coops must be at least 25 15 feet from the adjoining property lines and no closer than 50 40 feet from any adjacent residential dwelling or to any other building used for residential purposes, other than that of the owner of the chicken hens. All pens shall be located at least 3 feet behind the rear property building line of the principal structure. All pens enclosed permanent henhouses/coops shall not be located in the front yard, required street side yard, required side yard, nor shall be located in any drainage area that would allow fecal matter to enter any storm drainage system or stream. (78) Secure movable/portable henhouses/coops and chicken tractors must be located at least 15 20 feet from the adjoining property line and no closer than 2540 feet from any adjacent residential dwelling or to any other building used for residential purposes, other than that of the owner of the chicken hens. All secure movable/portable henhouses/coops and chicken tractors shall be located at least 3 feet behind the rear property building line of the principal structure. Pens may be portable and shall meet setbacks at all times. (89) All pens enclosures for the keeping of chicken hens shall be constructed and maintained as to prevent rodents or other pests from being harbored underneath, inside, or within the walls of the enclosure. All The henhouse/cooppens must be impermeable to rodents, wild birds, and predators, including dogs and cats. All enclosed pens must be kept dry, well-ventilated, and in sanitary condition at all times, and must be cleaned on a regular basis to prevent offensive odors. All manure not used for composting or fertilizing shall be removed promptly. Odors from chickens, chicken manure, or other chicken-related substances shall not be detectable at the property boundaries. (910) No dog or cat that kills a chicken hen will, for that reason alone, be considered a dangerous or aggressive animal. (1011)Adequate shelter, care and control of the chicken hens are required. Any person allowed to keep chicken hens under this section shall comply with all of the provisions and definitions of the Code of Virginia, as amended, and the Vinton Town Code, as amended, Code of Ordinances regarding care, shelter, sanitation, health, rodent control, 3 cruelty, neglect, noise, reasonable control and any other requirements pertaining to the adequate care and control of animals in the town. (1112) The chicken hen owner shall take necessary action to reduce the attraction of predators and rodents and the potential infestation of insects and parasites. Chicken hens found to be infested with insects and parasites that may result in unhealthy conditions to human habitation may be removed by an animal control officer.. (1213) All feed or other material intended for consumption by the chickens shall be kept in containers impenetrable by rats or other rodents, and such container shall be equipped with tightly fitting caps or lids. All feeding shall be conducted in a manner as to prevent unconsumed food from being accessible to other animals or rodents. The presence of rodents in an area used for the keeping of chickens shall be prima facie evidence that such area is maintained in violation of this section. (1314) Chicken litter and waste shall not be deposited in any trash container that is collected by any public and shall be disposed of by either composting on site or disposed of at a permitted solid waste facility in accordance with the applicable permit. Also, any dead birds shall not be deposited in any trash container that is collected by any public waste collector but shall be taken to the permitted solid waste disposal facility and properly disposed of in accordance with the receiving facility's applicable permit.? (we need to discuss this) (14) Disposal of chicken litter, waste, and dead birds in the public wastewater collection system is strictly prohibited since this may cause backups and/or overflows. (15) Persons wishing to keep chicken hens pursuant to this subsection must file an application for a zoning permit with the town's planning and zoning department. The application shall include a sketch showing the area where the chickens will be housed and all types and size of enclosures in which the chickens will be housed along with a twenty-five dollar fee the applicable fee as set by the town council. The sketch must show all property dimensions and setbacks. Once the site and enclosures have been inspected and approved by the town's animal control officer and/or planning and zoning staff, a permit will be issued by the planning and zoning department. The permit shall be valid for one year. Each existing permit must be renewed annually in January by filing an application with the town's planning and zoning department, along with payment of a twenty-five dollar renewal. The town's animal control officer shall make another inspection of the site, prior to the approval of the renewal application. (d) The above subsection (c) shall not apply to indoor birds, such as, but not limited to parrots or parakeets, or to the lawful transportation of fowl through corporate limits of the town. Summary In order for the City of Roanoke to undertake its Glade Creek Stream Restoration Project to reduce the E. coli and sediment loads within the Roanoke River, the City plans to stabilize and restore approximately 2,921 linear feet of Glade Creek, a tributary of Roanoke River. The Project is funded in part by Virginia Department of Environmental Quality (DEQ) Stormwater Local Assistance Funds (SLAF), and it entails repairing stream features and bank structures, grading for floodplain reconnection, increasing flood storage, and the establishment of a riparian buffer. The Project will involve properties located in the City of Roanoke, Roanoke County and the Town of Vinton. Staff has been in discussion with City of Roanoke and Roanoke County personnel in this Project since February 2021. A draft intergovernmental agreement was forwarded to the Town Attorney in May 2021 for his review. The agreement was provided to Town Council at its briefing on November 15, 2022. After the Council briefing, Staff was informed that the City’s Project will involve five (5) Town-owned properties, instead of six (6) Town-owned properties. WHEREAS, the City needs to perform certain work on the Property in connection with Roanoke’s Glade Creek Stream Restoration Project (“Project”), a public works project designed to reduce sediment and E. coli loads within the Roanoke River by stabilizing and restoring approximately 2,921 linear feet of Glade Creek, a tributary of the Roanoke River, and provide for the installation of stream features and bank structures, grading for floodplain reconnection, increasing flood storage, and establishment of a riparian buffer, and perform such other work on the Property, as described herein (the “Work”); 2 WHEREAS, the City expects to receive regulatory credits from the Commonwealth of Virginia Department of Environmental Quality for its performance of the Work in connection with the Project; WHEREAS, the Town has agreed to allow the City to perform such Work on the Property, in connection with the Project, and the Parties desire to enter into this Agreement to govern the terms and conditions under which the City may perform such Work on the Property. NOW THEREFORE, FOR AND IN CONSIDERATION of the terms and conditions stated herein, the Parties hereby mutually agree as follows: 1. Right of Entry – the Town hereby grants the City, its agents, employees, contractors and assigns a nonexclusive right of entry to enter the Property as shown on the sheets attached hereto as Exhibit B, which are incorporated herein by reference, for the purpose of completing the Work. The City agrees to provide two (2) working days prior written notice to the Town before entering the Property to perform any of the Work, including without limitation design, surveying, and other preliminary tasks related to the Work. 2. Easement – The Parties agree that pursuant to this Agreement, the City shall have right over the entirety of the parcels that comprise the Property to enter the Property and perform the Work, until such time as the scope of the project area on the Parcels may be identified and reduced to plats. The plats will be based on final Project As-Builts which is to be delivered post substantial completion of the Project. At such time, the above right of entry shall be reflected in permanent maintenance easements, (collectively, the “Easement”), which the Town shall convey the City across the Property to perform and maintain the Work and be recorded. The Parties agree that the Easements shall be substantially similar in form to the Deeds of Easement attached hereto as Exhibit C, which is incorporated herein by reference. 3. Description of Work and Project – The Parties agree that the scope of the Work to be 3 performed on the Property by the City, its agents, employees, contractors and assigns, shall be as described on the attached Exhibit D, which is incorporated herein by reference. The Town acknowledges that the Work and the Project have been thoroughly explained to its authorized representatives by the City, to the Town’s reasonable satisfaction, and the Town has no concerns about the Work or Project that are not addressed in this Agreement or the Easements. The Work shall be performed on the Property by the City, at the City’s sole cost and expense. 4. Consideration – The Town agrees that it shall convey the Easement described herein across the Property to the City for ten dollars ($10.00). 5. Restoration of Property – The City agrees that after the Work has been completed on the Property, it shall restore the Property to the same condition in which the Property existed prior to commencement of the Work by the City, as close as is reasonably practical. 6. The City shall require its contractors performing the Work to protect the Work and the Property, to prevent damage to the Work and the Property and to protect personal property and adjacent real property from any injury or loss arising in connection with the Work, including any damage to and/or loss of use and enjoyment by the respective owners. The City shall require its contractors to be responsible for the entire Work, and to indemnify and hold harmless the Town for any claims brought against the Town arising solely from the Work performed by such contractors on the Property. Any and all damage or injury caused on the Property by the City or its contractors as a result of the performance of the Work shall be repaired and/or replaced at the City’s sole expense. Such repair or replacement shall restore the damaged Property to the same condition in which the Property existed prior to commencement of the Work. The City and its contractors also shall perform the Work so as to not interfere with or unreasonably impede the use of Town’s recreational facilities that is located within County of Roanoke’s 5 property. The access path shall be cleared o f brus h , v ines and s mall trees to accommodate equipment mobilizati o n. Grantor agrees that Grantee sha ll h ave the ri g ht of access to portions of the Prope rt y outside of the area of the Pe rm an ent Easement and Tem po rary Easement if necessary to complete the Project. Grantee further acknowledges that upon completio n of the Project, it 3 !GOW9l~ :n272 1 will restore any of Granto r 's Property dis turbed or damaged solely a r esult of Grantee's W ork, to the sam e condition in which the Property existed prior to commencement of the Work performed by Grantee within the area o f such easements, at Grantee's expense. The Grantor agrees that the Grantee w ill not b e expected to restore the Property to the identical origi nal condition, but rather as n ear thereto as is practi cable to the same conditi on in which the Property existed at the t ime G rantee's work within s u ch easem ents commenced, and that the Grantor, at no cost to Grantor, wi ll coo perate with the Grantee in effectuating such restoration. Grantee agrees that it wi ll restore the land cl eared for the access path b y replanting vegetatio n, reseeding with grass, and removing any ma te ri a l pl aced in the access path for equipment mobilization. Grantee undertakes both directly and throug h its contrac to rs , to take every reasonab le precaution at all t imes fo r the protection of a ll persons and property at the locat io n of the Work or in the vici nity o f the Work or that may b e affected by it or such contractor's o peration in connection with the Work. Grantee agrees to require its contractors p erformin g the Work to maintain adequate protecti o n o f a ll the Work to prevent damage to it and s hall protect property from any injury or loss arising in connection with th e Work , and to protect adjacent propert y owners to prevent any d amage to it or loss of use and enjoyment by its owners . Grantee agrees to require its contractors to b e resp onsible for the ent ire Work, and to indemnify a nd hold harmless Granto r for any cla ims brought against Grantor arising solely from the Work performed by s uch contractors on the Propert y. Grantor ackno w ledges that it will take no action to obstruct th e easements herein granted, and that Grantor s hall not con struct or build any stru cture within the area of the Permanent Easem ent or Temporary Easement. 4 The Pennanent Easem ent conveyed herein, and the tenns, cond itions, and r estrictions imposed therein , shall be binding upon the Grantor and Grantor's agents, h eirs, a nd assigns, and successors in title, and s hall continue as a servitud e running in perpetuity with th e Property. AT A REGULAR MEETING OF THE VINTON TOWN COUNCIL, HELD ON TUESDAY, DECEMBER 6, 2022, AT 6:00 P.M., IN THE COUNCIL CHAMBERS OF THE VINTON MUNICIPAL BUILDING, LOCATED AT 3ll S. POLLARD STREET, VINTON, VIRGINIA WHEREAS, the City of Roanoke needs to perform certain work on Town-owned properties located along Glade Creek, in connection with the City of Roanoke’s Glade Creek Stream Restoration Project; and WHEREAS, the Project is a public works initiative designed to reduce sediment and E. coli loads within the Roanoke River by stabilizing and restoring approximately 2,921 linear feet of Glade Creek, a tributary of the Roanoke River, and WHEREAS, the Project is funded by Virginia Department of Environmental Quality (DEQ) Stormwater Local Assistance Funds (SLAF) and City of Roanoke, and WHEREAS, the Project entails the installation of stream features and bank structures, grading for floodplain reconnection, increasing flood storage, and establishment of a riparian buffer, etc., and WHEREAS, Town personnel have been in discussions with City of Roanoke and Roanoke County personnel about this Project since February 2021; and WHEREAS, the Town has agreed to allow the City to perform such work on the properties, in connection with the Project, and the City and the Town desire to enter into this Agreement to govern the terms and conditions under which the City may perform such work on the properties; and WHEREAS, the draft intergovernmental agreement has been reviewed by the Town Attorney and presented to Town Council at their regularly scheduled meeting on November 15, 2022; and WHEREAS, Council finds it to be in the best interest of the Town of Vinton to enter into an Intergovernmental Agreement with the City of Roanoke for the City to utilize and perform work on the necessary Town-owned properties for the Glade Creek Stream Restoration Project. NOW, THEREFORE, BE IT RESOLVED, BY THE COUNCIL OF THE TOWN OF VINTON, VIRGINIA, AS FOLLOWS: 1. Johnson, CMC, Town Clerk Meeting Date December 6, 2022 Department Town Clerk Issue Consider adoption of a Resolution dissolving the Public Safety Committee and the Economic Development Committee and establishing a new Community Development Committee Summary Council was briefed at their November 15, 2022 meeting regarding the current four Council Committees: Finance, Economic Development, Public Works and Public Safety. At that briefing, Town Staff recommended the following: • Dissolving the Public Safety Committee and referring any public safety items to the Public Works Committee or the Highway Safety Committee. • Dissolving the Economic Development Committee • Establishing a new Community Development Committee The new Community Development Committee will fulfill a need for a Committee to review items pertaining to the Planning & Zoning Department, the Community Programs & Facility Department, and the Office of Economic Development. At their organizational meeting on January 3, 2023, Council Members will be appointed to the Finance, Public Works and Community Development Committees for two-year terms. AT A REGULAR MEETING OF THE VINTON TOWN COUNCIL HELD ON TUESDAY, DECEMBER 6, 2022 AT 6:00 PM IN THE COUNCIL CHAMBERS OF THE VINTON MUNICIPAL BUILDING, 311 SOUTH POLLARD STREET, VINTON, VIRGINIA WHEREAS, there are currently four Council Committees: Finance, Economic Development, Public Works and Public Safety and Council Members are appointed to these Committees each election year for two-year terms; and WHEREAS, the Finance, Economic Development and Public Works Committees are active committees; however, since the Vinton Fire Station went under the umbrella of the Roanoke County Fire & EMS Department several years ago, the Public Safety Committee has not been active; and WHEREAS, Town Staff has recommended that the Public Safety Committee be dissolved and any items related to public safety be referred to the Public Works Committee or the Highway Safety Committee; and WHEREAS, Town Staff has also recommended that a new Community Development Committee be established to include the Economic Development Committee and that the current Economic Development Committee also be dissolved; and WHEREAS, the new Community Development Committee will fulfill a need for a Committee to review items pertaining to the Planning & Zoning Department, the Community Programs & Facility Department, and the Office of Economic Development. NOW, THEREFORE, BE IT RESOLVED that the Vinton Town Council hereby dissolves the Public Safety Committee and the Economic Development Committee and establishes a new Community Development Committee.
