Roll call After a Moment of Silence, Justin Davison led the Pledge of Allegiance to the U.S. Flag. Under upcoming community events, Council Member McCarty January 8 – 12:00-1:00 p.m. – Chamber Lunch N Learn – Charles Hill Community Center; January 9 – 11:30 a.m. – ribbon cutting – Real Estate; January 10 – 7:30 p.m. – Virginia Tech v. WVA – Lancerlot; January 11 – 7:30 p.m. – Virginia Tech v. UNC – 24 – 5:00-7:00 p.m. – Chamber After Hours – Rosie’s. Chief Foster made comments on the beginning of a New Year and departments are amazing future for Vinton. He then read a quote from Abraham Lincoln, “ the future is to create it yourself." Agenda. The Town Clerk commented that two corrections needed to be made to the December 3, 2019 minutes. On Page 5 bottom, the word “not” needs to be inserted after 2 paragraph, the type of dogs needs to be corrected from bulldogs to boxers. Vice Mayor Liles made a motion to approve the Consent Agenda as corrected seconded by Council Member McCarty and voting: Vote 5-0; Yeas (5) – McCarty, Scheid, Stovall, Liles, Grose; Nays (0) – None. Approved minutes of the Regular Council meeting of November 19, 2019; Regular Council meeting of December 3, 2019, as corrected and Regular Council meeting of December 17, 2019 Under awards, introductions, presentations, Justin Davison reviewed a PowerPoint presentation agenda package and is on file in the Town Clerk’s Office as a part of the permanent record. The next item on the agenda was to consider Streets, Sidewalks, and Other Public Places, Article III, Public Rights-of-Way Use Fee and Chapter 86, Service, Div Vinton Town Code. The Town Attorney first commented that the public rights-of- calculated by VDOT and has been charged since the late 90’s to every company that runs lines in the Town’s rights-of-ways. When small cell facilities was received from Cox reviewed the Town Code and di State law had been updated Code. The revisions will bring our Code in line with State law. With regard to the two items being deleted from the Code, one relates to the Consumer Utility T telephones and the other relates to the Enhanced Emergency Telephone Service tax. We continue under the Virginia Communications Sales and Use Tax and the streams as well as support the enhancements that we have on our E-9-1-1 system. In response to a question regarding the amount of revenue we receive each year, Ms responded we received $4-5,000 each year for right-of-way fees. The Town Manager commented that we get a schedule each year with the updated 3 charging even though the Code had not been updated. Council Member Scheid made the Ordinance seconded by Council Member Stovall voting: Vote 5-0; Yeas (5) – Stovall, Liles, Grose; Nays (0) – None. Adopted Ordinance No. 1012 amending Chapter 82, Streets, Sidewalks, and Other Public Places, Article III, Public Rights-of- Service, Division 2, Telephone and Division Service of the Vinton Town Code The Town Manager commented that several months ago Council was asked to pro topics for the upcoming Council Retreat to be held on February 21st. explained that he had gr categories. He requested Council to advise him or the Town Clerk if there are other topics that need to be included on the list. The broad categories are development, capital improvement program and water and wastewater system. Anne Marie Green with the Council of Community Services has been contacted about serving as our facilitator. purchase of the Goodwin property on December 27th. We environmental issues that were left and scheduling the demolition of the structures on the property. The Town Manager next expressed appreciation to Council for all of the support shown to him and his family in the loss of his Mother following which the Mayor and Members of Council made comment. The Mayor commented on the past year and how excited he is about the New Year everything that was accomplished in 2019. He also Council and entrusted them their taxes. Comments from Council: Vice Mayor Liles and Council Member McCarty reiterated comments and that they were looking forward to the New Year. on the Brownfield meeting held today and that she looked forward to working on that project. She next announced that she was also looking forward 4 re-election. Council Member Stovall expressed appreciation to staff for getting the Town calendars out. He also commented on the purchase of the Goodwin property legacy once something is built there to enhance the Town. The next item on the agenda was appointments to Boards/Commissions/Committees. Liles made a motion to re-appoint “Mick” Michelsen’s to the Board of Zoning Appeals to a new five-year term beginning January 17, 2020 and ending January 16, 2025; the motion was seconded by Council Member Scheid by the following vote, with all members voting: Vote 5-0; Yeas (5) – Grose; Nays (0) – None. Re-appointed Frederick J. “Mick” Michelsen to the Board of Zoning Appeals to a new five-year term beginning January 17, 2020 and ending January 16, 2025 The next item on the agenda was a request to convene in Closed Meeting, pursuant to Section 2.2- employment; assignment, appointment, promotion, resignation of specific public officers, appointees, or employees of any public body; namely the Chief of Police; Section 2.2- consideration of real property for a public purpose, relating to a sanitary sewer Methodist Church property and Section 2.2-3711 would adversely affect the bargaining position or negotiating strategy of the public body. Summary AMVETS made a donation to the Vinton War Memorial in the amount of $500.00 to be used to cover any expenses incurred for food or events for veterans, which was received into the Donations for Veterans Monument Revenue Account. At the end of FY 2018-2019 budget year, there was a remaining balance of $750.28 that rolled into the Re-Appropriated Fund Balance for FY 2019-2020 Council needs to re-appropriate funds from the Re-Appropriated Fund Balance to the Senior Recreation Program Account. Summary The Police Department’s current workstation utilized for storing and viewing in-car camera footage has a Windows 7 operating system that cannot be upgraded to Windows 10. The Kustom Signals’ software used for storing and viewing in-car camera footage must be installed on a specific workstation and the current software must be migrated from the current workstation to the new workstation. The Finance Committee reviewed this request at their January 14, 2020 meeting and recommends Council approval. Under the terms of the Performance Agreement, the Town agreed to appropriate to the Roanoke County Economic Development Authority an initial cash payment of $250,000 towards the purchase of eight (8) vacant parcels for the purpose of establishing the parking and pedestrian access for the site. Attachments None Recommendations No action required Town Council Agenda Summary Meeting Date January 21, 2020 Department Administration Issue Recognition of 2019 Employee of the Year Summary In November of 2016, the Town established an Employee of the Year Program. The purpose of the Program is to recognize employees who have served the Town of Vinton in an exceptional manner, by exemplifying outstanding service through his or her work and have exhibited a positive and supportive attitude. Nathan McClung, Principal Planner, was chosen at the fourth Employee of the Year and was recognized at the Employee Holiday Luncheon in December and will be present at the meeting. Summary The Town of Vinton and Roanoke County (County) entered into a Memorandum of Understanding effective July 1, 2019 that moved the responsibility for the Town’s utilization of the Regional Center for Animal Control and Protection (RCACP) to the County. The Virginia State Code allows revenue from animal licenses to be spent on expenditures associated with animal control. With Roanoke County assuming the costs of the shelter, the Town also stopped issuing separate animal licenses from the County. Town Council members wanted to continue to offer the opportunity for Town residents to purchase an animal license at the Municipal Building as a convenience. Town staff has worked with the Roanoke County Treasurer to become a remote location, and has agreed to terms in a separate Memorandum of Understanding. The Finance Committee reviewed this MOU at their January 14, 2020 meeting. Attachments Draft Memorandum of Understanding Recommendations No action required Town Council Agenda Summary 1 MEMORANDUM OF UNDERSTANDING BETWEEN ROANOKE COUNTY TREASURER’S OFFICE AND TOWN OF VINTON, VIRGINIA This Memorandum of Understanding (“MOU”) between the Roanoke County Treasurer’s Office (“Treasurer”) and Town of Vinton (“Town”) sets forth the understanding and responsibilities of the two parties regarding the issuance of Roanoke County animal tags by employees in the Town Treasurer’s office, for the residents of the respective localities. References to Town employees shall include all authorized individuals whom the Town has given access to confidential animal license information to assist with tag issuance. Access levels and method(s) of access shall be based on need and use requirements. All determinations regarding access levels and methods of access shall be at the sole discretion of the Treasurer after consultation with the Town. TERMS: During the term of this MOU, the Treasurer agrees to the following: 1. To provide access to confidential animal license information through Roanoke County’s Accounting Revenue Tax software suite for animal licenses; 2. To allow access to the Roanoke County data base for animal licenses for the purpose of allowing the Town the ability to issue animal tags to Town and/or County residents; 3. To provide training for efficient utilization in performing these duties; 4. To provide adequate inventory of Roanoke County animal tags for uninterrupted distribution; 5. To allow the Town the ability to submit a weekly payment to the Treasurer, along with the financial backup supporting the weekly sales accumulation for the issuance of individual tags for the same corresponding time period; and 6. To immediately suspend access to animal license software provided for any employee of the Town or the entire office of the Town Treasurer if the Treasurer determines, or has reason to suspect, one or more individuals is not in compliance with any or all procedures for safeguarding confidential information. During the term of this MOU, the Town agrees to the following: 1. To utilize the access to confidential animal license information provided by Roanoke County Accounting Revenue Tax software suite only for the issuance of Roanoke County animal tags as the Treasurer’s agent; 2. To complete all training required by the Treasurer, including refresher training; 3. To secure and maintain all animal tags inventory issued to them by the Treasurer; 4. To take reasonable steps to safeguard and keep confidential all animal license information; 2 5. To refer all FOIA requests for animal license information to the Treasurer, except for where the Town is the custodian of the records that are subject to the FOIA request and the Town has discretion over code enforcement through its staff; 6. To remit all funds weekly to the Treasurer, along with corresponding financial backup supporting the weekly sales accumulation for the issuance of individual tags for the same corresponding time period; and 7. To receive and maintain possession of said funds through its own software cashiering system until the funds are disbursed to the Treasurer on the agreed to weekly disbursement schedule. MODIFICATION: This MOU may be modified in writing from time to time as deemed mutually desirable and acceptable to the parties. No modification shall be binding unless signed by authorized representatives of both parties. EFFECTIVE DATE AND TERMINATION: This MOU shall become effective as of the date when both parties have executed it, and it shall remain in effect until terminated as provided for herein. This MOU shall be binding on the parties’ successors. Either party to the MOU may terminate the agreement at any time by providing written notice to the other party. 1 Meeting Date January 21, 2020 Department Police Issue Consider adoption of an Ordinance to amend Chapter 10, Animals, Article I, In General, Sections 10-18 and 10-19 of the Vinton Town Code Summary Council was briefed at their December 3, 2019 meeting on the proposed changes to the Animal Ordinance. Council also heard comments from a citizen regarding an incident that happened with their neighbor’s dogs and a request to make the Ordinance more enforceable by defining “trespassing”. Upon further review of the proposed Ordinance and consultation with the Town Attorney, final revisions were made to the attached Ordinance. It shall be the duty of every owner, as defined in Section 10-2, of an animal to exercise reasonable care and take all necessary steps and precautions to protect other persons, property and animals from injuries or damage that may result from his or her animal’s behavior. If the owner or custodian of an animal is a minor, the parent or guardian of such minor shall be responsible to ensure compliance with this section. This section shall be applicable to all properties, to include the animal owner’s property, unless the injured person is trespassing on the animal owner’s property. Sec. 10-19. Other violations; enjoining of violations. A violation of any provision of this chapter, excluding any section where a specific punishment is listed, shall be a class 4 misdemeanor. A separate offense shall be held to have been committed each day that such violation shall occur or continue. In addition to any other penalty imposed, the town may seek an injunction to enjoin the continuing violation of any provision of this chapter.
