Roll call After a Moment of Silence, Council Member Liles led the Pledge of Allegiance to the U.S. Flag. Under upcoming community events, Council Member McCarty announced the following events: May 5-Relay for Life-War Memorial; May 20-Vinton Wine & Food Festival-Explore Park; May 26- with Worx-Farmers’ Market; May 6-9:00 a.m. to 12 Noon-Glade Creek Greenway Clean-Up- end of Etna Avenue, adjacent to the greenway; May 13- Gallop 4 the Greenways and Triathlon- Greenways; Playhouse-May 12-28 and on May 13- Show-Thrasher Memorial events going on at the Senior Center. Council Member Scheid commented that the May 6th Clean- Greenway has been cancelled. Foster, the following awards were presented assistance of the Mayor, Captain Lieutenant Austin: Traffic Safety Award – Sergeant Timothy Lawless; DUI Award – Officer Matthew Stafford; Life Saving Awards – (1) - Sergeant Timothy Lawless, (2) - Sergeant Scott Hurt and Officer Terry Pittman, (3) - Officer Andrew DiCarlo and (4) Officer Matthew Stafford, Corporal Michael Giles and Captain Fabricio Drumond; Leadership Award – Sergeant Timothy Lawless and Officer of the Year – Sergeant Michael Caldwell. The Mayor presented the award to Anne Cantrell, Treasurer/Finance Director, and Lydia Verdillo, Financial Analyst, after Cantrell made brief comments. The next item on the agenda was the consideration of public comments regarding the proposed FY 2017- 2018 Town of Vinton Budget. The Mayor Public Hearing at 7:30 p.m. The Town Manager and Anne Fiscal Year 2017-2018. (A copy of the presentation is on file in the Town Clerk’s Office and will be made a part of the permanent record.) The Town Manager commented that the secon changes that have been made since it was meeting. Council Member Scheid asked rec Public Hearing opened 3 there is $42,000 in contractual services. Anita McMillan further commented that based on the City of Roanoke, the Town of Christiansburg and the Town of Blacksburg, the process is a minimum of 12- Manager commented that we would develop hopefully be able to implement a fee in th FY2018- asked if that would be enough to hire a consultant for this purpose and Ms. McMillan responded yes. Vice Mayor Hare commented that by establishing a stormwater fund he felt that we are ahead of everyone else. Vice Mayor Hare next commented on the $510 remaining in the contingency in the recommended that it be added to the $2,000 contribution to the Dogwood Festival Committee for a total of $2,510. On the Utility Fund side there is a contingency of $83,193 and he requested the Public Works Committee that contingency black hydrants that are around town. Joey Hiner responded that if the Town service, the membership with the Resource Authority would probably end. He did not know if any contracted company would fill that place because some of the would prefer to use. Mr. Hiner did not know the process involved to get out of the RVRA. Chief Guffey reported that the volunteer truck was marked up responded to 110 calls out of 138 for 80% and handled 101 of the calls for 73%. The f was 8.17. Chief Foster responded that they promoted the current Anima and they will be appointing a new one. Hare commented that our Animal Control Officer is only for cats and dogs and asked states about private citizens trapping nuisance animals Chief Foster responded that he would review the State Code and provide that information to Council and to Mr. Obenchain. Unfortunately, pretty decent gap in our revenues this year that are just starting to materialize as well as some higher spending than what we would have originally budgeted for. The revenues as we see them coming in now and were used to project the proposed FY2017-2018 would create a shortfall of approximately $100-170,000. They want to make sure the revenues are as realistic as can be projected before Council votes on a budget that might not be attainable and adjustments on what we are choosing to fund. Vice Mayor Hare requested that Council let the Finance Committee know order to balance the list of items that are being funded that are discretionary and send to Council by Friday. Johnson, Town Clerk Meeting Date June 6, 2017 Department Police Issue Briefing on proposed Ordinance to amend Section 78-5, “Dumping unsightly matter on highway, right-of-way or private property,” of Article I, “In General,” Chapter 78, “Solid Waste” of the Vinton Town Code for the purpose of reducing the penalty from a class 1 misdemeanor to a traffic infraction penalty with fine Summary The attached proposed ordinance would allow the Town of Vinton to treat the disposal of cigarette butts and other litter as civil violation as opposed to a Class 1 Misdemeanor as currently defined by state law. Under 33.2-802, littering in the Commonwealth is “punishable by confinement in jail for not more than 12 months and a fine of not less than $250 or more than $2,500, either or both. In lieu of the imposition of confinement in jail, the court may order the defendant to perform a mandatory minimum of 10 hours of community service in litter abatement activities.” This, of course, is a criminal conviction which remains on the offender’s criminal record. The proposed town ordinance would provide our officers the option of charging persons with a lesser offense punishable by a civil penalty of $50.00 payable to the Town Treasurer with no criminal conviction. This process would be much like that of receiving a parking ticket under the town code. The Town of Vinton police officers shall continue to have the option of charging under the state code should the situation warrant the harsher penalty due to the nature of the violation. AT A REGULAR MEETING OF THE VINTON TOWN COUNCIL, HELD ON TUESDAY, , 2017 AT 7:00 P.M., IN THE COUNCIL CHAMBERS OF THE VINTON MUNICIPAL BUILDING, 311 SOUTH POLLARD STREET, VINTON, VIRGINIA. AN ORDINANCE amending section 78-5, “Dumping unsightly matter on highway, right-of-way or private property,” of Article I, “In General,” Chapter 78, “Solid Waste” of the Vinton Town Code for the purpose of reducing the penalty from a class 1 misdemeanor to a traffic infraction penalty with fine; providing for an effective date. NOW, THEREFORE, BE IT ORDAINED by the Town Council of the Town of Vinton that section 78-5, “Dumping unsightly matter on highway, right-of-way or private property,” of Article I, “In General,” Chapter 78, “Solid Waste” of the Vinton Town Code, is hereby amended and reenacted as follows: Chapter 78 - SOLID WASTE ARTICLE I. – IN GENERAL * * * Sec. 78-5. - Dumping unsightly matter on public property, highway, right-of-way, park, or private property; civil penalty. (a) Any person shall be guilty of a class 1 misdemeanor who dumps or otherwise disposes It is unlawful for any person to drop, dump, deposit, discard, or otherwise dispose of trash, garbage, refuse, litter, cigarette butts, newspapers, fliers, food containers, or other unsightly matter, on public property, including a public highway, right-of-way, property adjacent to such highway or right-of-way, park, or on private property without the written consent of the owner thereof or his agent. (b) When any person is arrested issued a citation for a violation of this section and the matter alleged to have been dumped or disposed of has been ejected from a motor vehicle, the arresting issuing officer may comply with the provisions of section Code of Virginia, Code §§ 46.2-936-37 in making such arrest. (c) When a violation of the provisions of this section has been observed by any person and the matter dumped or disposed of has been ejected or removed discarded from a motor vehicle, the owner or operator of such motor vehicle shall be presumed to be the person ejecting or disposing of such matter. However, such presumption shall be rebuttable by competent evidence. (d) Any person convicted of such violation who violates this section shall be guilty of a class 1 misdemeanor subject to a civil penalty of fifty dollars ($50.00). The citation shall inform the violator that he or she may avoid a trial by paying this penalty by mail or in person to the treasurer of the Town of Vinton within fourteen (14) calendar days following the date of the citation. (e) If the person cited with a violation of this section does not elect to pay the penalty within fourteen (14) calendar days, the violation shall be tried in the general district court in the 2 same manner and with the same right of appeal as provided by law. A finding of liability shall not be deemed a criminal conviction for any purpose. (ef) The provisions of this section shall not apply to the lawful disposal of such matter in trash receptacles and landfills. * * * This ordinance shall take effect on , 2017. Johnson, Town Clerk Meeting Date June 6, 2017 Department Police Issue Briefing on Urban Archery and Deer Culling in the Town of Vinton Summary At the request of the Vinton Public Safety Committee, the Vinton Police Department examined potential methods for controlling the town’s deer population. Option 1 – An “Urban Archery” program which, under Virginia Department of Game and Inland Fisheries (DGIF) guidelines, would allow licensed hunters to hunt deer in the town annually between October and December. Limited large tracts of land in the town make this option problematic as deer will normally run some distance after being shot. This method is further complicated by the fact that state law requires all hunters to obtain the permission of the land owner before retrieving game that has been killed. Option 2 – Hiring a licensed contractor to cull the deer population. Prices were obtained from two companies in the Roanoke Valley. Blue Ridge Wildlife Management stated they would charge approximately $190.00 per deer killed. “An All Animal” provided a verbal estimate of $100 to $140 per deer killed. Option 3 – Hiring law enforcement officers to kill deer within the town limits as permitted by the DGIF. This option will require the purchase specialized rifles with sound suppression devices, overtime pay for the involved officers, and a $60.00 per deer processing fee after the deer are killed. This option will likely prove to be nearly as costly as Option 2. Based on the cost of the aforementioned options, the fact that citizen complaints have been minimal, and deer/car collisions are uncommon in the Town of Vinton; it is recommended that this issue be tabled. The issue could then be revisited in the future should the deer population become more problematic. CEDS documents analyze regional economies and serve as guides for establishing regional goals and objecti ves, developing and implementing regional action plans, and identifying investment priorities and funding sources. A CEDS integrates a region's human and physical capital planning in the service of economic development. Integrated economic development planning provides the flexibility to adapt to global economic conditions and fully utilize the region's unique advantages to maximize economic opportunity for its residents. A CEDS is the result of a continuing economic development planning process developed with broad-based and diverse public and private sector participation. A CEDS must set forth goals and objectives necessary to solve economic development problems of the region and must clearly define metrics of success. Finally, a CEDS provides a useful b enchmark by which a regional economy can evaluate opportunities with other regions in the national economy. A CEDS is a precondition for funding under most of the Economic Development Administration's (EDA) grant funding programs. CEDS documents provide regions with an additional funding avenue for public infrastructure improvements that support regional economic development and alleviate economic development problems in a region. This project is funded in part by the US Economic Development Administratio n, an agency of the US Department of Commerce. The Roanoke Valley-Alleghany Regional Comprehensive Economic Development Strategy Committee shall support the ongoing economic development planning process in the Roanoke Valley - Alleghany Region, a region consisting of the Counties of Alleghany, Botetourt, Craig and Roanoke; the Cities of Covington, Roanoke and Salem and the Towns of Clifton Forge and Vinton.
