Mayor Grose called the meeting to order at 6:01
p.m. The Town Clerk called the roll with Council
Member Liles, Council Member McCarty, Council
Member Stovall, Vice Mayor Mullins,

After a Moment of Silence,Council Member
Liles led the Pledge of Allegiance.
Announcements, and Council Activities, Council
Member McCarty announced the following events:

July 3 – Town Offices will be closed in observance
of Independence Day.

Vice Mayor Mullins announced the following

Vice Mayor Mullins made a motion to approve
the Consent Agenda as presented; the motion was
seconded by Council Member Stovall and carried

Approved minutes of the Regular Meeting of
June 2, 2026, and adopted Resolution No. 2679
appropriating funds in the amount of $2,539.50
for the receipt of an insurance claim made on a
town vehicle that was damaged in a collision.

Under Citizens’ Comments and Petitions, Mrs.
Janet Scheid spoke about the Second Amended
and Restated Intergovernmental Agreement
regarding the Roanoke Valley Greenway. She
shared that the agreement lacks clarity on if and
how the Greenway Commission can continue to be

finalized version due to the compliance section not
being ready. The final report will be ready in the
next two weeks.

The report indicated the best opinion that a locality
can receive with the Financial Statements being
correct in all aspects.
The major change in FY24 was the closure of the
remaining account balances to the General Fund.

Mr. Peters presented a Resolution to renew terms
on a Lease of Real Property with Vindo’s, LLC. He
shared this is the third renewal for Macado’s. The
parking lot supports employee and patron parking.
Macado’s has been good stewards of the property.

Mayor Grose shared appreciation to Macado’s for

Under Public Hearing, Mayor Grose opened the
proposed amendments and additional
appropriation to the Town of Vinton’s FY2025-
2026 budget to appropriate funding for building
equipment, furniture and fixtures, traffic signals, a
vehicle purchase, paving and striping, stormwater
projects, and various operational expenditures,
including personnel expenditures, maintenance
projects, contractual services, and training in the
total amount of $1,612,300 in the General Fund
and the Capital Fund.
Mr. Sexton shared that this Resolution is
presented typically in June as a year-end cleanup
for revenues that may be running as surplus,
along with expenditures that are either doing
better than expected or need to be rightsized.
He reviewed the Budget Transfer sheet that was
included in the agenda packet.
There were no public comments.
Vice Mayor Mullins said that was very well
explained.
Mayor Grose asked for clarification on the use of
interest.
Mr. Sexton explained that in the Capital Fund the
interest in investments is listed at $10,000. That is
additional dollars that staff had not previously
allocated, so the Town is running approximately
$200,000 on interest earnings for the year in the
Capital Fund. Of these funds, the Town used
$100,000 to help buy down the cost of the Vinton
War Memorial Park and $80,000 to help purchase
the fire property.
Mayor Grose shared that those property

Under Town Attorney, no comments were
offered.
Under Town Manager’s Projects Updates, Mr.
Peters shared that pre-construction meeting for the
project was held today. This project should start the
week of July 6 and will be completed within six to
eight weeks. This project will require road closures.
He then reminded everyone of the Independence
Day Celebration on July 4th. The Four on the 4th
race has been relocated to Downtown Vinton, so it
County has donated some decorations and made
a financial contribution to the event.
Under Council and Mayor Comments, Council
Member Liles shared that he is looking forward to
the summer in Town and looking forward to all the
things.
Council Member McCarty shared compliments on
the Land and Liberty: The Vinton Story play. She
then gave a shout-out to the Dogwood Restaurant
and shared that she attended Mingle in the Market.
Vice Mayor Mullins complimented the paving work
and the Land and Liberty: The Vinton Story play.
She is looking forward to the fireworks.

Member McCarty for another four years to serve on
Town Council. Vice Mayor Mullins acknowledged
another four years as well. He complimented the
Mingle in the Market and the crowd that it brought
to the Town.
Mayor Grose thanked the staff for the work they put
into Town projects. He also shared appreciation for
supporting his staff.
Council Member Liles agreed with the comments
on Chief Drumond.

Update on major corridor improvement and greenway projects.
Summary
Town staff have been actively involved in several Federal Highway Administration (FHWA) and
Virginia Department of Transportation (VDOT)-funded transportation and greenway projects.
Staff involvement began with the preparation and submission of grant applications and has
continued through project implementation, with Town personnel serving as the Town's Project
Manager.
The following projects are currently underway:
1. Walnut Avenue Corridor Improvements – Phase 3 (UPC 119472) – Administered by the
VDOT Salem District.
2. Dogwood Boulevard and Hardy Road Roundabout (UPC 124089) – Administered by the
VDOT Salem District.
3. Glade Creek Greenway Phase 3 Preliminary Engineering Study (UPC 124024) –
Administered by the Roanoke Valley-Alleghany Regional Commission (RVARC).
4. Route 24 Pedestrian Safety Improvement Project (UPC 125069) – Administered by the
VDOT Salem District.
5. Vinyard Road Pedestrian Safety Improvement Project – Administered by the Roanoke
Valley-Alleghany Regional Commission (RVARC).
6. Road Safety Audit – Hardy Road – Administered by the Town with the assistance of
professional consultants.

Agenda Summary
1
Town Council Project Updates:
1. Walnut Avenue Corridor Improvements – Phase 3 (UPC 119472)
Project Limits: From 0.061 miles west of 4th Street to 0.242 miles east of 4th Street.
This project will construct approximately 1,600 linear feet of new sidewalk on the north
side of Walnut Avenue and approximately 700 linear feet of new sidewalk on the south side.
It also includes pavement markings for approximately 1,600 linear feet of bike lanes and
the installation of a new crosswalk at 2nd Street.
The project is being administered by the Virginia Department of Transportation (VDOT)
Salem District. Since October 2023, Town staff have continued to meet regularly with the
VDOT Salem District Project Manager to coordinate project development. Since January
2024, Town personnel have also held multiple meetings with property owners and business
owners along the project corridor to discuss the project and address questions and
concerns.
Funding Source: SMART SCALE
Estimated Total Project Cost: $7.7 million
Preliminary Engineering (Survey, Environmental, and Design): Estimated cost of
approximately $757,039. This phase began in February 2023, and final design was
completed in March 2026.

Right-of-Way (Property Acquisition, Easement Acquisition, and Utility Relocation):
Estimated cost of approximately $555,818. This phase began in April 2025. As of June 30,
2026, the VDOT Project Manager reported that all affected property owners had signed the
purchase agreements.
Construction: Estimated cost of approximately $2,684,923. The project is anticipated to
be advertised for bids on October 13, 2026, with construction expected to be completed in
Fall 2027.
2. Dogwood Boulevard and Hardy Road Roundabout (UPC 124089)
The purpose of this project is to enhance safety, increase intersection capacity, and
improve traffic flow by replacing the existing signalized intersection at Dogwood Boulevard
(formerly Bypass Road) and Hardy Road with a single-lane roundabout featuring three slip
lanes.
The project also includes relocating the entrance to the bank property approximately 110
feet west, constructing a new bank exit onto Roop Street, installing crosswalks with
pedestrian refuge islands on Dogwood Boulevard and Hardy Road, and constructing new
sidewalk connections to existing pedestrian facilities.
During construction, southbound Dogwood Boulevard traffic that currently turns left onto
Hardy Road will be detoured for approximately four to six months.

In 2023, the average daily traffic volume at the intersection was approximately 15,400
vehicles on Dogwood Boulevard (Route 24) and 12,200 vehicles on Hardy Road (Route
634).
The project is being administered by the Virginia Department of Transportation (VDOT)
Salem District. Since August 2024, Town staff have continued to meet regularly with the
VDOT Salem District Project Manager to coordinate project development. The project is
currently in the right-of-way acquisition phase.

3. Glade Creek Greenway Phase 3 Preliminary Engineering Study (UPC 124024)
This project will provide pedestrian and bicycle accommodation from the Glade Creek
Greenway Phase 2 trailhead parking area at Gus Nicks Boulevard to Vinyard Park.
The project is being administered by the Roanoke Valley-Alleghany Regional Commission
(RVARC). A project kick-off meeting with RVARC and Virginia Department of Transportation
(VDOT) personnel was held on August 28, 2024. RK&K was selected as the project
consultant in May 2025. Town staff continue to meet regularly with RVARC and RK&K to
coordinate project development and preliminary engineering activities.

4. Route 24 Pedestrian Safety Improvement Project (UPC 125069)
Overall, the project includes 14 pedestrian crossing improvements, including 5 locations at
unsignalized intersections and 3 signalized intersection locations. These pedestrian
crossing improvements include ADA-compliant curb ramp installations, newly marked
crosswalks, pedestrian signal heads with pedestrian countdown signals, reconstructing
existing access entrances, and pedestrian refuge islands. The project area extends from
the signalized intersection at PFG on West Virginia Avenue eastward towards the
intersection of South Pollard Street, and then northward before terminating at Jefferson
Avenue.

5. Vinyard Road Pedestrian Safety Improvement Project
The project includes improvements that will include pedestrian accommodations
(sidewalks, ADA ramps/curb cuts, crosswalks) and the reconstruction of commercial
entrances along the corridor to improve pedestrian access/safety, transit access, in
addition to reducing congestion. No right-of-way acquisition will be required as a part of
this project. As a part of this project, concrete sidewalks will be constructed in the existing
right-of-way area that will be separated from the existing roadway throughout a majority of
the project area. A crosswalk will be added to the location of an existing bus stop and
shelter area that will allow pedestrians to access the eastern section of the project area on
Vinyard Road. An additional crosswalk on the southern portion of the corridor will provide
pedestrian access to the Clearview Manor Apartments, which is a senior low-income
housing apartment building that contains 100 residential units.
The project is being administered by the Roanoke Valley-Alleghany Regional Commission
(RVARC).

• Preliminary Engineering is the only funded facet of the project currently with the

• The scope of work for this project includes 100% PE plans for the improvement
project, which will allow for greater accuracy when applying for those future grant
funds for construction.
6. Road Safety Audit – Hardy Road
Through the Safe Streets and Roads for All (SS4A) analysis, the Town of Vinton has
determined that Hardy Road, from Maple Street to Dogwood Boulevard, is identified on the
High Injury Network (HIN).The HIN roadways represent the worst 10% of roadways within
the Town, accounting for approximately 2/3 of all severe injury and fatal crashes. The
proposed project scope includes the work to complete a road safety audit (RSA),
identifying safety concerns, and recommend improvements for the Hardy Road corridor.
The end result will include short-and long-term recommendations that are supported by
the Town and VDOT for future implementation funding.

This Amended and Restated Intergovernmental Agreement (“Agreement”) is made and
entered as of July 1, 2026 by and among the City of Roanoke, Virginia, a Virginia municipal
corporation, the City of Salem, Virginia, a Virginia municipal corporation, the Town of Vinton,
Virginia, a Virginia municipal corporation, the County of Roanoke, Virginia, a Virginia political
subdivision, the County of Botetourt, Virginia, a Virginia political subdivision (each a
“Locality”), and the Roanoke Valley-Alleghany Regional Commission, a Virginia political
subdivision under the Regional Cooperation Act (“RVARC”), each a “Party” and together the
“Parties.”
Recitals
A. The City of Roanoke, the City of Salem, the Town of Vinton and the County of
Roanoke entered an Intergovernmental Agreement Establishing the Roanoke Valley Greenway
Commission in 1997, and revised the Intergovernmental Agreement in 2008. The foregoing
localities and the County of Botetourt further revised and adopted the Amended and Restated
Intergovernmental Agreement Establishing the Roanoke Valley Greenway Commission dated as
of July 1, 2016.
B. The Amended and Restated Intergovernmental Agreement provided for the
creation and operations of a regional, intergovernmental board called the Greenway Commission
pursuant to Section 15.2-1300 of the Code of Virginia of 1950, as amended (the “Code”).
C. RVARC is a political subdivision of the Commonwealth created pursuant to the
provisions of the Regional Cooperation Act, Chapter 42 of Title 15.2 of the Code (the “Act”) with
the purpose, among others, of encouraging regional cooperation and coordination with the goals
of improved services to citizens and increased cost-effectiveness of governmental activities.
D. The City of Roanoke, City of Salem, Town of Vinton, and Counties of Roanoke
and Botetourt (the “Participating Localities”) wish to set forth the terms under which the Greenway
Commission will be reorganized as RVARC’s Greenway Committee and some of the functions
previously carried out by the Greenway Commission will be incorporated into the Regional
Commission’s regional strategic plan documents (the “Work Plan”) in accordance with the Act.
Agreement
NOW THEREFORE, in consideration of the foregoing premises, which are expressly
incorporated herein, together with the mutual promises hereinafter contained, the Parties agree as
follows:
1. Purpose. The purpose of this Agreement is to promote and facilitate coordinated
direction and guidance in the planning, development and maintenance of a system of greenways
throughout the Roanoke Valley. This Agreement will replace the Amended and Restated

Intergovernmental Agreement Establishing the Roanoke Valley Greenway Commission, which is
being repealed by the parties thereto by separate action. This Agreement is an intergovernmental
agreement, and is not intended to be a joint exercise of powers under Section 15.2-1300 of the
Code.
2. Addition to Work Plan.
a. The Parties agree that RVARC is responsible for carrying out the work, through
its own forces or through contractors or partners and in consultation with the
Greenway Committee, of planning, supporting, coordinating and community
engagement with the Greenway System. The Parties agree that these
responsibilities shall be set forth with more particularity in the annual RVARC
Work Plan, which shall control over this Section in the event of a conflict.
b. The Participating Localities shall, as part of the Work Plan, fund the budget
submitted to them by RVARC on the same basis that bills for the Roanoke
Valley Transportation Planning Organization (TPO) are calculated. RVARC
shall make all budget requests not later than February 1 prior to the fiscal year
for which such request is made.
c. RVARC shall make reasonable and diligent efforts to obtain grants and
donations in support of the Greenway program.
3. Benefits of Greenway System. The greenway system, in which each greenway is
owned and operated by the Locality in which it is located, is intended to enhance the quality of life
for Valley citizens and visitors and to:
a. Provide safe and efficient alternative transportation linkages among
recreational sites, open spaces, residential areas, employment centers,
educational and cultural facilities and other activity centers;
b. Encourage citizen wellness and maintain environments that promote
opportunities for recreational activities;
c. Protect environmental assets and retain beneficial ecological habitats;
d. Maintain a contiguous urban forest ecosystem to reduce community-wide
environmental problems such as excessive stormwater runoff, air quality
degradation, water pollution and urban climate change;
e. Promote an appreciation for the Valley’s natural, historical and cultural
resources and its neighborhoods;
f. Protect and link significant remnants of the community’s undeveloped open
spaces, woodlands and wetlands; and
g. Enhance the Valley’s appearance to encourage tourism, promote economic
development and improve the living environment for residents.

4. Continuation of Greenway Committee in Advisory Role.
The Parties agree that the Greenway Committee shall continue in an advisory role in order
to assist RVARC in carrying out its responsibilities under this Agreement. Its responsibilities and
duties are:
a. To study the needs of the Roanoke Valley and the desires of the Valley residents
as expressed in the most recent Roanoke Valley Greenways Plan; to review
these plans every five years and assist RVARC in preparing any necessary
additional provisions or revisions and to encourage inclusion of a coordinated
system of greenways into each Participating Locality's planning efforts;
b. To advise and inform RVARC and to assist it in advising and informing the
governing bodies and citizens of the Valley of existing, planned and potential
opportunities for potential greenways within the Valley;
c. To make recommendations to RVARC and the governing bodies relative to
desirable federal, state, and local legislation concerning greenway programs
and related activities;
d. To apprise RVARC of and assist it in soliciting funding, grants, and/or
donations of land, property or services from the Commonwealth of Virginia,
the United States of America, their agencies, private citizens, corporations,
institutions and others to promote, construct or maintain greenways within the
Roanoke Valley;
e. To advise RVARC on pursuing and promoting public/private partnerships,
work with nonprofit organizations, and facilitate cooperation among Valley
governments in developing, constructing and maintaining a system of
greenways throughout the Valley;
f. To assist RVARC and the Participating Localities with developing project plans
and timetables and defining roles and responsibilities.
5. Effective Date, Establishment of Greenway Committee and Parties.
This Agreement shall be effective on July 1, 2026. The Greenway Committee will, on that
date, cease to exist as an independent joint exercise of powers board under the provisions of
Section 15.2-1300 of the Code and become an advisory body of RVARC in its activities under this
Agreement and the Work Plan. Additional participating localities may be added as parties to this
Agreement upon unanimous approval of an amendment to this Agreement by the Parties (including
such additional parties as may be added through such amendments).
6. Membership.
a. The Greenway Committee shall be composed of members appointed as follows:
i. Up to three (3) members from each of the Participating Localities, to be
appointed by their governing bodies for staggered terms of three (3)
years. Each member shall be a resident of the locality that he or she
represents;

ii. Up to (1) member appointed by the Roanoke Valley Transportation
Planning Organization for a term of three (3) years;
iii. Up to two (2) staff members from each of the Participating Localities,
appointed by the chief administrative officer; and
iv. One member appointed by Pathfinders for Greenways, Inc., the
nonprofit group established to support greenways in the Roanoke
Valley.
b. In addition to the above members, one representative from each of the following
organizations, who shall have voice but not vote at meetings of the Greenway
Committee:
i. The Western Virginia Water Authority;
ii. Such interested organizations as the Greenway Committee may
approve.
c. A vacancy for the remainder of a term shall be filled by the governing body or
person making the original appointment. An appointment to fill a seat vacated
during a term shall be only for the remainder of a term. Members whose seats
are not filled shall continue to serve until a replacement is appointed. Members
may succeed themselves.
d. The members of the Greenway Committee shall serve without compensation.
7. Meetings.
a. The Greenway Committee shall hold regular meetings at least once per quarter
per year. The Greenway Committee shall be a public body subject to the
Virginia Freedom of Information Act, Chapter 37 of Title 2.2 of the Code.
Meetings may be called at the request of RVARC, the chair or written request
of a majority of members.
b. The Greenway Committee may adopt bylaws to conduct the affairs of the
Committee.
c. The Greenway Committee may establish committees as necessary to fulfill the
duties and responsibilities of the Greenway Committee.
8. Duration.
a. This Agreement shall remain in force until terminated or modified by approval
of all Parties.
b. This Agreement may be amended by approval by the governing bodies of each
Participating Locality.
c. A Participating Locality may withdraw from this Agreement by resolution
without need of approval of the other Participating Localities.

9. Insurance for Greenway Committee. RVARC shall procure liability insurance for
the members of the Greenway Committee, and retain such insurance in full force and effect. The
cost of the premium for such insurance shall be allocated as a cost under Section 3.b.
10. No Liability of Officials. No provision of this Agreement shall be deemed a
covenant, agreement, or obligation of any present or future, director, officer, employee, or agent
of RVARC, the Greenway Committee or any Participating Locality in his or her individual
capacity, and neither shall any officer, employee, or agent thereof executing this Agreement or any
related instrument be liable personally on this Agreement or be subject to any personal liability by
reason of the execution and delivery thereof. No officer, employee or agent of RVARC, the
Greenway Committee or any Participating Locality shall incur any personal liability with respect
to any other action taken by him or any of the transactions contemplated hereby or thereby,
provided he or she acts in good faith.
11. Integration. This Agreement, including the exhibits hereto, constitutes the full and
complete agreement of the Parties respecting its subject matter, and any prior or contemporaneous
agreements or understandings, whether written or oral, are hereby merged into and superseded by
the provisions of this Agreement. This Agreement may only be amended or supplemented by a
subsequent writing of equal dignity except where expressly set forth herein.
12. Sovereign Immunity. Nothing in this Agreement is intended to waive, or shall be
construed to waive, the sovereign immunity of any party.
13. Not a Pledge of Faith and Credit. The financial obligations of RVARC and the
Participating Localities under this Agreement shall be carried out only to the extent of funds duly
appropriated and lawfully available therefor.
14. Counterparts. This Agreement may be executed in several counterparts, each of
which shall be an original, and all of which together constitute one and the same instrument.
Electronic signatures are permitted in accordance with the Virginia Uniform Electric Transactions
Act.

No. 1076, repealing the Amended and Restated Intergovernmental Agreement
Establishing the Roanoke Valley Greenway Commission in anticipation of
adopting the revised agreement; and
WHEREAS, the Second Amended and Restated Intergovernmental Agreement regarding the
Roanoke Valley Greenway continues the regional partnership among the
participating localities while updating the governance, membership, and
operational provisions; and
WHEREAS, the Town Council has reviewed the Second Amended and Restated
Intergovernmental Agreement Regarding the Roanoke Valley Greenway and finds
that its adoption is in the best interests of the Town of Vinton and its citizens.
NOW, THEREFORE, BE IT RESOLVED by the Vinton Town Council as follows:
1. The Town Council hereby approves the Second Amended and Restated
Intergovernmental Agreement.
2. The Town Manager is hereby authorized and directed to execute the Second Amended
and Restated Intergovernmental Agreement on behalf of the Town of Vinton.
3. Upon execution by the participating localities, the Second Amended and Restated
Intergovernmental Agreement shall supersede all prior versions of the agreement and
shall become effective in accordance with its terms.

Belcher; and
WHEREAS, pursuant to Virginia Code §§ 15.2-1813 and 15.2-2006, the Town Council
has advertised a public hearing to discuss its proposal to vacate its interest in these two portions of
the Town-owned Walnut Avenue right-of-way and convey those vacated portions to The Lafferty
Family LLC and Jeffrey W. and Amy L. Belcher, and Town Council has held a public hearing
regarding the proposed vacation and conveyance; and
WHEREAS, the Walnut Avenue Corridor Improvements Phase 3 Project will significantly
improve pedestrian access and safety along Walnut Avenue, provide for safer bicycle
accommodations, and complete a connection for the Town of Vinton’s Glade Creek Greenway
and the City of Roanoke’s Tinker Creek Greenway; and
WHEREAS, vacating the Town’s interest in these two portions of the Town-owned
Walnut Avenue right-of-way will advance the completion of the Walnut Avenue Corridor
Improvements Phase 3 Project; and
WHEREAS, the Town Council of the Town of Vinton finds that it is in the best interests
of the citizens of the Town of Vinton to vacate and convey those two portions of the Town-owned
Walnut Avenue right-of-way to The Lafferty Family LLC and Jeffrey W. and Amy L. Belcher as
part of VDOT’s and the Town’s development of the Walnut Avenue Corridor Improvements Phase
3 Project.

NOW, THEREFORE, BE IT ORDAINED by the Council of the Town of Vinton,
Virginia, that the Town Council of the Town of Vinton hereby: (i) vacates the Town’s interest in
that portion of the Town-owned Walnut Avenue right-of-way, consisting of 1,397.48 square feet,
as shown as the dark grey highlighted area on the Virginia Department of Transportation Plan
Sheet (Project No. 0149-149-257; Sheet No. 4; Revised Mar. 19, 2026), recorded on May 21, 2026,
as Instrument No. 202604507, at State Highway Plat Book 19, Pages 42-43 (the “Plan Sheet”),
which Plan Sheet is attached to this Ordinance; (ii) approves the conveyance to The Lafferty
Family LLC of that portion of the vacated right of way, consisting of 1,178.29 square feet, that
adjoins Roanoke County Tax Parcel No. 060.15-03-11.00-0000 (221 Walnut Avenue), as shown
on the Plan Sheet; (iii) approves the conveyance to Jeffrey W. and Amy L. Belcher of that portion
of the vacated right of way, consisting of 219.19 square feet, that adjoins Roanoke County Tax
Parcel No. 060.15-03-12.00-000 (219 Walnut Avenue), as shown on the Plan Sheet; (ii) authorizes
and directs the Mayor and/or the Town Manager to execute any instruments, including a quitclaim
deed, as either of them, acting individually, shall deem appropriate to convey the Town’s interest
in the right-of-way to the adjoining parcel owners; and (iii) authorizes and directs the Mayor and/or
the Town Manager to take such other actions as either of them, acting individually, may consider
necessary to carry out the purposes of this Ordinance.
BE IT FURTHER ORDAINED, that this Ordinance shall take effect immediately upon
and after its passage.

Consideration of public comments concerning a request by CMART Holdings, LLC that Council
adopt a proposed ordinance vacating, abandoning, and discontinuing any right, title, or interest the
Town may have in a 10 foot wide, 115.01 foot long (for a total area of 1,150 square feet), platted
but unopened and undeveloped alley that extends in a northerly direction from the 500 block of
East Cleveland Avenue near its intersection with Pine Street and bisects the parcel identified as
528 East Cleveland Avenue (Tax Parcel ID: 060.16-08-29.00-0000).
Summary
Town staff is requesting that an unopened and undeveloped alley that bisects the parcel identified
as 528 East Cleveland Avenue be vacated, abandoned, and discontinued. A major portion of this
undeveloped alley runs through the middle of the existing structure that currently contains a
commercial space and seven (7) residential units. The Town was aware of this alley both before
and during the redevelopment of this property, and it was the intention of Town staff to request
this vacation/abandonment soon after its completion. There are no adverse impacts to the property
or the property owners to complete this process, however it allows for future deed, title, and land
research and loan processes to not become problematic or cumbersome.

This Ordinance of Vacation is adopted this 7th day of July, 2026, by the Town Council of
the Town of Vinton, Virginia, the governing body of the TOWN OF VINTON, VIRGINIA.
WHEREAS, CMART Holdings, LLC is the owner of NEW LOT 9A and NEW LOT 8A
as shown on the “Alley Vacation, Resubdivision, and Combination Plat for CMART Holdings,
LLC, Being the Resubdivision of Lots 8, 9, 10, Section 5, Vinton Land, Loan, and Building Co.,”
dated June 26, 2023, prepared by Balzer & Associates, and recorded in the Clerk’s Office of the
Circuit Court for Roanoke County on July 17, 2023, as Instrument No. 202305299 (the “Plat”);
and
WHEREAS, NEW LOT 8A is bisected by a 10’ platted but unopened and undeveloped
alley, consisting of 1,150 square feet, that extends southerly from the northern boundary of NEW
LOT 8A along its frontage on another 10’ alley a distance of 115.01 feet to the southern boundary
of NEW LOT 8A along its frontage on East Cleveland Avenue, as shown on the Plat, which alley
is labeled as “10’ Alley To Be Vacated, 1,150 Sq. Ft.” (the “Alley”); and
WHEREAS, the public may have a right-of-way over the Alley, as identified on the “Map
of Lots Belonging to the Vinton Land, Loan, and Building Co.,” dated March 1889 and recorded
in the Clerk’s Office of the Circuit Court for Roanoke County at Plat Book 1, Page 5; and
WHEREAS, CMART Holdings, LLC has applied to the Town of Vinton, pursuant to
Virginia Code § 15.2-2006 and the Town’s Undeveloped Right-of-Way Vacation Policy, to have
Town Council vacate, abandon, and discontinue any interest the Town may have in the Alley; and
WHEREAS, the Town does not claim any interest in the Alley, and it has not opened or
developed the Alley; and
WHEREAS, Town Council has determined that the Alley serves no public purpose, that
neither the Town nor the public has any interest in or need for the Alley, and that vacating,
abandoning, and discontinuing the Alley will not impede or alter access for any property owners;
and
WHEREAS, Town Council has determined it is in the best interests of the Town to vacate,
abandon, and discontinue any interest the Town may have in the Alley; and
WHEREAS, the requirements of Virginia Code § 15.2-2006 have been met, this Ordinance
has been properly noticed for a public hearing, and Vinton Town Council held the duly noticed
public hearing on July 7, 2026; and

WHEREAS, Town Council finds that the Alley has no value to the Town or the public and,
therefore, waives any right to compensation for the vacation; provided, however, CMART
Holdings, LLC shall be responsible for all costs associated with processing this vacation request.
NOW, THEREFORE, BE IT ORDAINED AND ENACTED by the Town Council of the
Town of Vinton, Virginia, as follows:
1. The Town Council of the Town of Vinton vacates, abandons, and discontinues any
right, title, and interest the Town may have in the 10’ platted but unopened and
undeveloped alley, consisting of 1,150 square feet, that extends southerly from the northern
boundary of NEW LOT 8A along its frontage on another 10’ alley a distance of 115.01
feet to the southern boundary of NEW LOT 8A along its frontage on East Cleveland

3. The Town Manager and Town Attorney, either of whom may act individually, are
authorized and directed to record a certified copy of this Ordinance with the Clerk of
Rockbridge County Circuit Court, where this Ordinance shall be recorded as deeds are
recorded and indexed in the name of the Town of Vinton.
4. The Mayor and the Town Manager, either of whom may act individually, are
authorized and directed to take such further actions as may reasonably be necessary to carry
out the purposes of this Ordinance, including, without limitation, the execution and
delivery of a quitclaim deed to CMART Holdings, LLC concerning the alley being vacated,
abandoned, and discontinued in this Ordinance.
5. The recitals to this Ordinance are an integral part of this Ordinance and are
incorporated into this Ordinance.
6. This Ordinance shall become effective immediately.
