I. Call to Order—Roll Call II. Briefing 1. Proposed amendments to the Vinton Zoning Ordinance. The proposed amendments would: add a new use type of commercial kitchens and commissary kitchens to the use table in Article IV (District Regulations) and add a definition for these use types in Article XI (Definitions); and amend multiple provisions and requirements for Planned Unit Development Districts in Article IV, Division 4 (Planned Unit Development Districts). The proposed amendments would: add a new use type of commercial kitchens and commissary kitchens to the use table in Article IV (District Regulations) and add a definition for these use types in Article XI (Definitions); and amend multiple provisions and requirements for Planned Unit Development Districts in Article IV, Division 4 (Planned Unit Development Districts). a. Adjournment PLANNING COMMISSION WORK SESSION AND PUBLIC HEARING OCTOBER 27,2025 PAGE 2 Chairman Liles called the work session to order at 6:02 p.m.He asked Ms. Tucei to call the roll.Ms.Tucei called the roll, and all members were present. The following members of Town Staff were present: Anita McMillan,Nathan McClung, and Julie Tucei. First on the work session agenda was the briefing on the proposed amendments to the Vinton Zoning Ordinance.The proposed amendments would:add a new use type of commercial kitchens and commissary kitchens to the use table in Article IV (District Regulations) and add a definition for these use types in Article XI (Definitions); and amend multiple provisions and requirements for Planned Unit Development Districts in Article IV,Division 4 (Planned Unit Development Districts). Mr. McClung gave the briefing on the proposed amendments to the Planned Unit Development Districts by reading from the Memorandum included in the meeting packet, a copy of which will be made a part of the permanent record. Mr. McCoy provided three comments on the proposed amendments. First, he suggested reconsidering including the wording"block or neighborhood"because those could be defined in different ways by different people. Mr. McClung stated that we may just say"within a development"rather than in a "block or neighborhood". Mr. McCoy questioned the perimeter buffer and how it affects providing access to a development. Mr. McClung said that we can clarify the word buffer and/or can just say that the landscaping ordinance must be followed. Mr. McCoy also brought up the portion that allows the use of different minimum requirements.He said that sometimes the ordinance and the master plan don't match and later, if there are new staff in the Planning Department, it might be hard for them to track what is required having both the ordinance and master plan to follow. Mr. McCoy said we should encourage creative development,but with some guardrails around it. He mentioned that maybe staff could be given the ability to waive or change certain things like landscaping requirements or perhaps required setbacks. Chairman Liles, Vice Chairman Jones, Mr. Benninger, and Mr. Mullen thought that Mr. McCoys suggestions were good and should be considered for inclusion into the Planned Unit Development amendments. It was agreed that Planning staff will do more research and rewrite sections of the amendments and then will present a revised copy to the Planning Commission during a November work session, date to be determined. The Planned Unit Development amendments will be tabled during the Public Hearing portion of the meeting. As the work session time had run over a bit, it was decided to adjourn it and begin the public hearing portion of the meeting. Mr. McCoy made a motion to adjourn the work session,and Vice Chairman Jones seconded the motion. The work session was adjourned at 6:39 p.m. Chairman Liles called the regular session to order at 6:43 p.m. He asked Ms. Tucei to call the roll. Ms. Tucei called the roll, and all members were present. The following members of Town Staff were present: Anita McMillan,Nathan McClung, and Julie Tucei. The first item on the agenda was the approval of the minutes of the meetings held on February 20, 2025, and April 29, 2025. There were no changes or additions to the minutes. Mr. McCoy made a motion to approve both sets of minutes as submitted. Vice Chairman Jones seconded the motion. A roll call vote was taken, and all members voted in favor of the motion to approve the minutes as submitted. PLANNING COMMISSION WORK SESSION AND PUBLIC HEARING OCTOBER 27,2025 PAGE 3 The next item on the agenda was the public hearing on the proposed amendments to the Vinton Zoning Ordinance.The proposed amendments would: add a new use type of commercial kitchens and commissary kitchens to the use table in Article IV (District Regulations) and add a definition for these use types in Article XI (Definitions); and amend multiple provisions and requirements for Planned Unit Development Districts in Article IV, Division 4 (Planned Unit Development Districts). Chairman Liles opened the public hearing at 6:44 p.m. and asked for the report from staff. Mr. McClung presented the section of the staff report, a copy of which will be made part of the permanent record for this meeting,regarding adding a new use type of commercial kitchens and commissary kitchens to the use table in Article IV (District Regulations) and adding a definition for these use types in Article XI (Definitions). Mr. McClung mentioned that there has been interest expressed in this type of kitchen use, especially for caterers and food truck owners, and that is why we are looking to add it to our ordinance. He mentioned that it will also cover existing businesses such as Ms. Custer's baking kitchen located at 709 E. Jackson Avenue. Vice Chairman Jones asked if it would have included a business like the former KB Mercantile on Washington Avenue which sold ice cream inside their store and cotton candy at a stand outside on the lawn. Mr. McClung said it would not include that type of business since they were zoned for retail sales. Mr.McClung said the building commissioner considers this type of use like a restaurant,even though they don't sell food onsite. Mr. McClung mentioned that we may want to consider adding coffee roasters to the kitchen use list. Mr. McCoy had one question about this amendment. He asked if we would have the tools to say when a business has exceeded a small-scale kitchen and moves to an industrial-sized kitchen. He is concerned about the amount of truck traffic that could be created if a kitchen were to grow to an industrial level. Chairman Liles said the size of the building should be regulated to keep them small scale. McCoy said you could regulate them by limiting the number of ovens allowed. Members liked a 2,500 square foot limit on the size of the kitchens and felt that should be enough to keep them small scale. Additional research is needed on this amendment, so it was decided that it would also be tabled and presented at a November work session on the same date as the Planned Unit Development amendment. There were no further questions from the Planning Commission. There were no citizens in attendance; therefore, there were no public comments. Chairman Liles closed the public hearing at 7:08 p.m. Mr. McCoy made a motion to table all the proposed amendments to the Zoning Ordinance until a future work session in November so that further research can be done and so the suggested changes can be incorporated into the amendments. The motion was seconded by Vice Chairman Jones. A roll call vote was taken and all members voted in favor of the tabling of all the proposed amendments. With there being nothing further to discuss, the public hearing was adjourned on a motion by Chairman Liles and a second by Mr. McCoy at 7:09 p.m. Respectfully Submitted, Anita McMillan Planning Commission Secretary
